HomeMy WebLinkAbout17609 - RESOLUTIONS - 7/31/1991 RESOLUTION NO. 17609 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, PROVIDING FOR AND GIVING NOTICE OF A SPECIAL MUNICIPAL ELECTION CONSOLIDATED WITH THE GENERAL ELECTION TO BE HELD ON NOVEMBER 5, 1991, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED ELECTORS OF SAID CITY, APPROVAL OF A FIRE SUPPRESSION BENEFIT ASSESSMENT DISTRICT. - - ---- - ---- --- --- -- ----------- -- --------- ----- -- -- -- -- Y WHEREAS, State law, specifically Government Code Sections 50078 et sea., provide a mechanism whereby a city may create an assessment for fire suppression services, ' for the purpose of obtaining, furnishing, operating, and maintaining fire suppression, equipment or apparatus, or for the purpose of paying the expenses of maintaining adequate fire fighting personnel; and WHEREAS, the City's Fire Chief has compiled the City of Palm Springs' Fire Chief's report on City-Wide Fire Suppression Assessment District, dated July 31, 1991, which determines that current fire suppression equipment and facilities are not adequate to provide the level of safety and protection against fire hazards desired in the City; and WHEREAS, that report estimates the cost of providing additional fire suppression services within the community, describes various categories of properties in the city, and allocates the degree of additional fire suppression services demand generated by each such category; and ' WHEREAS, the report recommends a methodology for establishing an assessment which generates the needed revenues to meet the community's fire suppression needs, pursuant to an allocation of the amount of fire services demands generated by each land use category; and WHEREAS, the City Council on June 19, 1991, determined to place the question of the establishment of the Fire Suppression Benefit Assessment to a vote of the people of the City of Palm Springs; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PALM SPRINGS AS FOLLOWS: Section 1• That there shall be and there is hereby ordered a special municipal election, to be consolidated with the general election to be held November 5, 1991, for the purpose of submitting to the qualified electors of said city, the following measure, to wit: Shall the Fire Suppression Benefit Assessment, imposing an annual levy not to exceed the following assessment schedule be used to improve existing fire suppression services, be adopted? A) Category I - Residential (single family detached, condominiums, mobile homes, time shares) $38.40 to $64.00. B) Category II - Vacant acreage $30.00 to $60.00. C) Category III - Commercial (industrial, manufacturing, mercantile, multi- family dwellings, etc.) $128. to $640. [ ] Yes [ ] No ^L F Res. No. 17609 Page 2 5&;tion 2. The measure shall be designated on the ballot by a letter printed on the left margin of the square containing a description of the measure, as provided by Section 10219 of the Elections Code. Section 3. Pursuant to California Elections Code Section 5011, the City Clerk is directed to transmit a copy of the measure to the City Attorney, and the City Attorney is directed to prepare an impartial analysis of the measure, showing the effect of the measure on existing law, and the operation of the measure. " Section 4. The Board of Supervisors of the County of Riverside is hereby requested to consolidate the Special Municipal Election to be held in the City of Palm r Springs on November 5, 1991, with the general election to be held on the same date; and to issue to all officers of said county charged with duties pertaining to said general election instructions take any and all steps necessary for the holding of said consolidated election. Section 5. The Registrar of Voters is hereby authorized to canvas the returns of :said Special Municipal Election, and said election and said general election shall be held in all respects as if they were only one election, and only one form of ballot shall be used. Section 6. The City of Palm Springs shall reimburse the County of Riverside in full for such services rendered, upon presentation of a proper invoice to the City Clerk of the City.
