RESOLUTION NO. 17608 OF THE CITY COUNCIL OF THE CITY OF PALM y SPRINGS, CALIFORNIA, AUTHORIZING CERTAIN OF ITS MEMBERS TO FILE WRITTEN ARGUMENTS REGARDING A CITY BALLOT MEASURE WHEREAS, a Special Consolidated Municipal Election is to be held in the City of Palm Springs, California, on November 5, 1991, at which there will be submitted to the qualified electors of said City, the following measure: Shall an ordinance, which creates a new special Tourism Paid Advertising Fund to exclusively fund paid advertising to promote the City as a tourist and visitor destination, and which shifts to the new Tourism Paid Advertising Fund from the City's General Fund the one percent (1%) transient occupancy taxes collected by the City pursuant to Municipal Code Section 3 . 24 . 036, be adopted? [ ] Yes [ ] No NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Springs, as follows: Section 1. The City Council, being the legislative body of said City, hereby authorizes Tuck Broich and Chuck Murawski, members of said body, to file written arguments in favor of the City measure set forth in the recitals hereof in accordance with Article 1, Chapter 3 , Division 5 of the Elections Code of the State of California, and to change said arguments until and including the date fixed by the City Clerk after which no arguments for or against said City measure may be submitted to the City Clerk. Section 2 . The City Council, being the legislative body of said City, hereby authorizes Sonny Bono and Earl Neel, members of said body, to file written arguments in opposition to the City measure set forth in the recitals hereof in accordance with Article 1, Chapter 3 , Division 5 of the Elections Code of the State of California, and to change said arguments until and including the date fixed by the City Clerk after which no arguments for or against said City measure may be submitted to the City Clerk. Section 3 . The above members of said body are hereby authorized in accordance with all of the requirements of Sections 4015. 5 and 5014 .5 of the Elections Code of the State of California, to file rebuttal arguments not exceeding 250 words, which rebuttal arguments shall be filed with the City Clerk not more than ten (10) R 1/608 Page 2 days after the final date for filing direct arguments. Rebuttal arguments shall be printed in the same manner as the direct arguments. Each rebuttal argument shall be printed in the same manner as the direct arguments and shall immediately follow the direct argument which it seeks to rebut. Section 4 . The provisions of Section 3 hereof shall apply at the municipal election to be: held in the city on November 5, 1991, and shall then be repealed. Section 5. In accordance with Section 3016 of the Elections Code of the State of California, if more than one argument for or against the City � measure set forth above is submitted to the City Clerk: within the time prescribed, the City Clerk is hereby authorized and directed to select one of the arguments in favor and one of the arguments against the measure for printing and distribution to the voters. In selecting the argument the City Clerk shall ' give preference and priority in the order named to the argument of the following: (a) the legislative body, or member or members of the legislative body authorized by that body; (b) the individual voter or bona fide association of citizens, or combination of voters and associations, who are the bona fide sponsors or proponents of the measure; (c) bona fide association of citizens; and (d) individual voters who are eligible to vote on the measure.
