OF THE CITY COUNCIL OF THE CITY OF PALM
SPRINGS, CALIFORNIA., APPROVING CASE 5.0421-PD-
185-D AN APPLICATION BY THE DESERT HOSPITAL
CORPORATION FOR REVISED MASTER PLAN AND ,
AMENDMENT TO A PLANNED DEVELOPMENT DISTRICT
AND APPROVING AN AMENDMENT TO THE GENERAL
PLAN, CASE 5.0588-GPA, TO EXPAND THE
PROFESSIONAL/HOSPITA,L LAND USE DESIGNATION
NORTH OF MEL AVENUE BETWEEN VIA
MIRALESTE/AVENIDA PA.LOS VERDES.

WHEREAS a Planned Development (District Application by the Desert
Hospital (Case 5. 0421-PD-185) in lieu of a change of zone to "P"
was approved by the City Council on November 18 , 1987 , for a multi-
phased project including high-rise buildings, parking, and
helicopter pad; and
WHEREAS the City has received an application by the Desert Hospital
Corporation for a revised master plan and amendment to a planned
development district application for expansion of the hospital. site
north of Mel Avenue which necessitates an amendment to the General
Plan to expand the professional./hospital land use designation north
of Mel Avenue between Via Mi:raleste/Avenida Palos 'Verdes; and
WHEREAS the Planning Commission considered the project at a duly
noticed public hearing held on July 10, 1991; and

WHEREAS the Planning Commission recommended they filing of a
Negative Declaration of environmental impact with mitigation
measures finding there is no substantial evidence that the project
contains any significant unmitigated environmental impacts; and
WHEREAS the Planning commission recommended approval with
conditions as outlined in its Resolution No. 4145; and
WHEREAS the City Council held a duly noticed public hearing on July
31, 1991, on said project; and
WHEREAS the City Council has reviewed all evidence provided at the
hearing including the staff report dated July 10, 1991, and all
other written and oral 'testimony and find the Project, subject to
the conditions contained herein consistent with the requirements of
the ordinances of the City and with State Law.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of
Palm Springs, California, after considering the evidence provided
at the hearing does hereby approve the revised master plan and
amendments to the planned development district application and the
amendment to the General Plan for the property hereinabove
described in accordance with the following findings and subject to
the following conditions:
SECTION 1. The City Council finds:
a. That the hospital expansion plan is consistent with the
existing General Plan land use plan and policies which have
designated this area as the Hospital District. since 1966.
b. That the project is consistent with the proposed draft General
Plan text on file with the State of California Office of
Planning and Research (OPR) and there is a reasonable
probability that it will be consistent with the revised
General Plan when adopted in that the project is consistent
with the overall. density and land use character of the General
Plan which allows for hospital and medical uses in this area.

' Planned Development District application which was approved by
the City Council in 1987.
' C. That there is little or no probability the P y project will be
detrimental to or interfere with the future adopted General
Plan if the project is ultimately inconsistent with that plan
in that with the firm establishment of the hospital district
in place, the only probable alternatives would be differing
intensities of development. If a lower or higher intensity of
development is adopted, the project would probably not be
detrimental to the plan.
d. That the planned development district application including
the necessary General Plan amendment for the proposed hospital
expansion including ,high rise structures was accepted as a
complete application prior to OPR granting the city a time
' extension on July 16, 1991, for the General Plan update.
e. That the planned development district application including
the necessary General Plan amendment for the proposed hospital
expansion including high rise structures is proper and
authorized and satisfies the requirements of the Zoning
Ordinance for high-rise buildings as it relates to the
property development standards and meets the intent of the
Zoning Ordinance as it relates to the open space and setback
requirements in that;
1. The Planned Development District Zoning Ordinance Section
9403 . 00 gives the City Council discretion to approve
specific development standards unique to each planned
` development district which may be at variance with
otherwise applicable zoning standards or provisions;
2 . The MOB structure meets the high-rise setback
requirements of Section 9304 .00 with the exception of
isolated intrusions of minor roof elements;
3 . Open space requirements will comply with the development
standards in the underlying "P" Zone and will comply with
the high-rise development standards of Section 9304 . 00 to
the extent practicable in light of pre-existing
` structures -- in no event will available open space fall
below 40% of the site area.
f. That the vacation of Paseo E1 Mirador and Avenida Palos Verdes
are consistent with the General Plan for the City of Palm
Springs.
g. That the hospital expansion program is necessary and desirable
for serving the continuing health care needs of the community,
and is in harmony with the objectives of the General Plan
including amendments proposed at this time and is not
detrimental to the existing uses.

h. That the 30. 9 acre site is adequate in size and configuration
to accommodate the expansion program and all property
development standards in order to adjust the hospital to the
neighborhood.
i. That a planned development district in lieu of a change of
zone to "P" was previously approved by the City Council and is
in place including necessary conditions of approval and
mitigation measures adopted to reduce environmental impacts to
a level of insignificance.
j . That the project is located on Indian Canyon Drive, Tachevah
Drive and Via Miraleste, all of which are required to be fully
improved in order to carry the type and quantity of traffic
generated by the hospital at full build-out with the required
mitigation measures.

k. That the proposed conditions are deemed necessary to protect
the public health, safety and general welfare of the +
surrounding community.
SECTION 2 . The project is approved subject to the following
conditions; all of which have to be: satisfied prior to issuance of
certificate of occupancy unless otherwise specified.:
GENERAL CONDITIONS:
a. The applicant/owner shall defend, idemnify, and hold harmless
'the City of Palm Springs, its agents, officers, and employees
.from any and all. claims, actions, or proceedings against: the
City of Palm Springs or any of its agents, officers or r
employees to attack, set aside, void, null or otherwise
challenge any approval, certification or determ:inatiowby the
City of Palm Springs, its advisory agencies, or legislative
body, concerning the above referenced project Case 5. 0423.-PD-
185-D and 5. 0588-GPA. The City shall nonetheless have
exclusive control over its defense in any such proceeding,
including but not limited to the right to designate counsel.
the City of Palm Springs will promptly notify the +
applicant/owner of any such claim, action, or proceeding
against the City of Palm Springs and will cooperate fully in
the defense.
b. That all Development Committee conditions dated May 22 , and
July 8, 1991, shall be met.
C. That final development plans shall be submitted in accordance
with Section 9403 . 00 of the Zioning ordinance.
d. That all mitigation measures of the environmental assessment
for Case 5. 0421-PD-•185-D as well as outstanding mitigation
measures set forth for Cases .5. 0421-PD-185 shall be met.
e. That the allowance for the Medical Office Building (MOB) high--
rise design is predicated on the vacation of Paseo E1 Mirador.
If such vacation is not approved, then the MOB shall be re-
designed to fit on the site and meet "P" Zone and high-rise
design standards.
f. That all costs associated with the vacation and reconstruction
of Paseo E1 Mirador and Avenida Palos Verdes including walls,
:Landscape, utilities, curbs, gutters demolition and the like
will be borne by the Desert Hospital.
g. Prior to approval of the final development plans for Phase I,
the hospital shall demonstrate ownership of all parcels within
the boundaries of the planned development district. _
h. A preliminary landscape plan shall be submitted for review and
approval prior to approval of final development plans for
Phase I. The plan shall show a common landscape theme
throughout the project and shall serve as a landscape master +
plan to be used as a guide for preparation of detailed
landscape plans.
i. The open space requirement of 60% for high-rise complexes
shall be fulfilled to the degree possible by this project.
Areas which contain decorative paving, as well as the E1
Mirador project in total, may be used to satisfy this
requirement. The final determination of compliance shall rest
with the Planning Commission in reviewed final detailed plans.
j . Decorative paving or other unifying streetscape design
technique shall be required along the entire length of the
main drive in order to increase the open space percentage and
create an identifiable main drive.

k. The hospital and all associated uses shall continue to comply
with Regulation XV as required by the South Coast Air Quality
Management District
1. The location of trash enclosures for the parking structure on
Indian Canyon Drive shall be indicated on the site plan prior
to approval of final development plans for Phase I.
m. That the developer shall seek and obtain approval of vacation
of the remaining portion of Paseo E1 Mirador from Avenida
Palos Verdes prior to issuance of building permits.
n. That the developer shall seek and obtain approval of vacation
of Avenida Palos Verdes from Paseo El Mirador northerly to
Camino Monte Vista prior to issuance of building permits.
•� o. That the Medical Office Building shall be reviewed by the
Planning Commission to reduce the massiveness of the building
as it faces Indian Canyon, including architectural components.
The action of the Planning Commission shall be final.
TRAFFIC MITIGATION CONDITIONS:
a. The developer will install the recommended traffic signals as
required by City Traffic Engineer and will be installed at the
request of Director of Community Development at the time the
required traffic signals meet volume warrants.
b. Stop signs shall be constructed as reviewed and approved by
City Traffic Engineer within the site at all unsignalized exit
points to control traffic. Internal traffic signing/striping
shall be implemented in conjunction with detailed construction
plan's for the project.
C. Sight distance at each intersection shall be reviewed and
approved by the City Traffic Engineer with respect to the City
of Palm Springs sight distance standards at the time of
preparation of final landscape and street improvement plans.
d. Curb-return type driveways shall be constructed at each of the
access points on adjacent streets to facilitate ingress/egress
to the site.
e. The developer will construct right turn only islands on both
southern driveways on Indian Canyon ' Drive at completion of
Phase I.
f. The parking along the following streets shall be reviewed by
the City Traffic Engineer who will designate what parking will
be removed to provide adequate capacity for traffic volumes
that will be generated by this project:
Via Miraleste - Tachevah Drive to Mel Avenue
Tachevah Drive - Indian Canyon to Avenida Caballeros
Avenida Palos Verdes -Paseo E1 Mirador to Mel Avenue
g. The timing of parking removal shall be determined by the
City's Traffic Engineer.
h. Detail parking plans shall be submitted for approval in
accordance with General Condition "b" above. Parking spaces
shall be provided in accordance with Section 9306. 00 of the
Zoning Ordinance. All parking stalls shall be installed a
minimum of 50 feet from the end of curb return from Indian
Canyon Drive to allow for stacking.
i. As a part of final development plan review, the site plan
shall be reviewed by the Planning Commission to reduce on-site
circulation conflicts, design drive openings, provide for
curb-side parking, eliminate the drop-off channel north of the
El Mirador and Oncology buildings, and assure that median
island breaks align with driveway openings.

PARKING STRUCTURE CONDITIONS:
a. With the development of the parking structures, more open '
space shall be developed; that once the parking structures are
built, then parking lot "A°' shall be developed into open
space.
b. That an architectural relief (i.e. , portions of the wall could
be recessed in to form an architectural compliment to the
building) be designed to break-up the street elevations for
the parking structure as proposed in Phase II, and that
pedestrian access be indicated on the site plan before final
development plans for Phase I:I are approved.
C. That the parking garage and other structures are approved
subject to all conditions :Listed above and those of the
Development Committee. r
