HomeMy WebLinkAbout17566 - RESOLUTIONS - 7/3/1991 ' RESOLUTION NO. 17566 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING CASE 5.0574-PD-215/TTM 26364 FOR A 77 UNIT SINGLE FAMILY RESIDENTIAL SUBDIVISION LOCATED ON SUNRISE WAY BETWEEN RACQUET CLUB ROAD/VIA ESCUELA, R-1-C ZONE, SECTION 2. WHEREAS the City has received an application by Racquet Club Properties for a Planned Development District for a 77 unit single family residential subdivision located on Sunrise Way between Racquet Club Road/Via Escuela (the Project) ; and WHEREAS the Planning Commission considered the Project at a duly noticed public hearing held on April 24, 1991; and r WHEREAS the Planning Commission recommended approval with conditions as outlined in its Resolution No 4124; and WHEREAS the City Council held a duly noticed public hearing on July 3, i 1991, on said project; and WHEREAS the City Council has reviewed all evidence provided at the hearing including the staff report dated July 3, 1991, and all other written and oral testimony, and find the Project, subject to the conditions contained j herein consistent with the requirements of the ordinances of the City and with State law. NOW THEREFORE BE IT RESOLVED that the City Council of the City of Palm Springs, California, after considering the evidence provided at the hearing does hereby approve the Preliminary Planned Development District for property hereinabove described in accordance with the following findings and subject to the following conditions: SECTION 1. The City Council finds: k a. That a Planned Development District and Tentative Tract Map are the appropriate applications for this 77 lot subdivision. b. That the proposed single family development is a suitable and desirable use For the community. c. That the proposed development is consistent with the General Plan designation of L4 and CDL6. d. That the site being approximately 20 acres is adequate to accommodate this project. r e. That Sunrise Way, Racquet Club Road, Via Escuela and Paseo de Anza are adequately designed to accommodate any traffic generated by this project. ` f. That the conditions imposed are necessary to protect the public health, safety and general welfare of the community. ' SECTION 2. The Project is approved subject to the following conditions; all of which are to be satisfied prior to issuance of certificate of occupancy unless otherwise specified: a. That the Development Committee conditions dated April 24, 1991, be met. r / Res. No. 17566 1 1 Page 2 i b. The proposed development of the premises shall conform to all applicable a regulations of the Palm Springs Zoning Ordinance, Municipal Code, or any other City Codes, ordinances and resolutions which supplement the zoning district regulations. c. This project has a de minimis impact on fish and wildlife as that term is defined in Section 711.2 of the Fish and Game Code and a Certificate of Fee Exemption will be completed by the City and two copies filed with the County Clerk. A $25.00 administrative fee must be submitted by the applicant in the form of a money order or cashier' s check payable to the Riverside County Clerk prior to Council action on this Planned Development District and Tentative Tract Map. This application shall not be final until such fee is paid or the Certificate of Fee Exemption is filed. d. The final development plaris shall be submitted -in accordance with 1 Section 9403.00 of the Zoning Ordinance. Final development plans shall include site plans, building elevations, floor plans, roof plans, grading plans, landscape plans, irrigation plans, exterior 'lighting plans, mitigation monitoring program, site cross sections, property development standards and other documents as required by the Planning Commission. Final development plans shall be submitted within two „ (2) years of the City Council approval of the preliminary planned development district. Failure to timely obtain approval shall make this approval null and void. e. The codes, covenants and restrictions shall be submitted to the City for approval . f. Prior to issuance of a building permit or recordation of final map the applicant must provide a standard avigation easement and non-suit covenant in a form prescribed and approved by the City Attorney with reference to the present and future owners of the parcel . g. Construction of any residential unit in the "N" overlay zone shall meet minimum soundproofing requirements prescribed pursuant to Section 1092 and related sections of Title 25 of the California Administrative Code. ' h. The 16 units requested in excess of the units allowed by right of zone according to net acreage shall be subject: to affordability restrictions, including an initial sales price affordable to moderate income families (defined as interest, taxes and insurance payment not exceeding 30% of gross monthly income) and resale restrictions to insure long term affordability. Specific restrictions shall be determined by the Housing Division of the Economic Development Department of the City of Palm Springs, and shall be recorded against the property in form approved by City Attorney. This number represents the number of units being requested in excess of maximum density allowed 1 by the underlying zoning. r i . A maintenance district or a homeowner's association in form approved by City Attorney shall be established to provide for maintenance of the 25 foot landscape buffer along Sunrise Way.
