HomeMy WebLinkAbout17549 - RESOLUTIONS - 6/19/1991 RESOLUTION NO. 17549 A RESOLUTION OF THE COUNCIL OF THE CITY OF PALM SPRINGS DECLARING RESERVE PERSONNEL TO BE EMPLOYEES OF THE CITY OF PALM: SPRINGS IN THE EVENT THAT THE RESERVES ARE NOT COVERED UNDER THE CALIFORNIA EMERGENCY SERVICES ACTT FOR WORKERS ' COMPENSATION WHEREAS Resolution No. 13502 , adopted on August (5, 1980, provided for continued participation in the California Emergency Council, which provides workers' compensation coverage for "Disaster Service Workers" , as it applies to volunteer workers. r WHEREAS Resolution No. 15894, adopted on April 16, 1986, provided that, in the absence of specified workers' compensation coverage provided by the California. Emergency Council, "Disaster Service Workers" program that, said reserves shall be deemed employees of the City of Palm Springs for the limited purpose of providing them with workers' compensation coverage while performing services for the City; and WHEREAS workers' compensation insurance for this program is provided by the State of California, through the State Compensation Insurance Fund, covers volunteer workers while actively* performing disaster service worker functions and training for such duties; and WHEREAS circumstances may arise relative to events held within the community when it is in the best interest of I:he City to have reserve volunteer workers participate. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs as follows. Section 1. That Resolution No. 15344 is hereby rescinded. Section 2 . That in the event volunteer reserve personnel of the City of Palm Springs are not covered for the purposes of Worker' s Compensation Insurance under the California Emergency Services Act, said reserves shall. be deemed 6.o be employees of the City of Palm Springs for the limited purpose of providing them with Workers' Compensation coverage while preforming disaster services, graining and participation in community events, when requested by the City as a part of their reserve volunteer status, to provide such services. Section 3 . That for purposes of this resolution, volunteer reserve personnel are those volunteers who have been officially accepted for membership and are registered in the Reserve Police, Fire, Mounted Police and Aero Squadron groups of the City. Section 4 . That the City :Manager or his designated representative shall have the authority to determine and approve: when it is in the best interest of the City to have reserve volunteers participate in community events.
