OF THE CITY COUNCIL OF THE CITY OF PALM
SPRINGS, CALIFORNIA, ACCEPTING A FIVE-YEAR
PROPOSAL FROM DESERT ADVENTURES, INC. , DATED ' '
MAY 28, 1991, TO OPERATE THE MOLLY TROLLEY r
VEHICLES.
WHEREAS Desert Adventures, Inc. , has an agreement with Sunline Transit Agency
to operate the Molly Trolley vehicles through the end of :rune, 1991; and y
WHER17AS the City has been notified by Desert Transit Agency that the three
Molly Trolley vehicles will be turned over to the City on July 1, 1991; and
WHEREAS the City Council desires that the tour portions of the existing Molly '
Trolley operation with Desert Adventures, Inc. , continue; and
WHEREAS the City Council finds that the continued operation of the tours '
utilizing the Molly Trolley vehicles is in the best interest of the public
and, indeed, is a desirable tourist amenity which it wishes to maintain for
the growth of the local economy; and
WHEREAS the City Council finds that the acceptance of the proposal from
Desert Adventures, Inc. , falls under the non-public project contractual
services provisions of the Palm Springs Muncipal Code, Section 3. 12. 280, and
does not require competitive bidding; and
WHEREAS Desert Adventures, Inc. , has submitted a proposal dated May 28, 1991, 4
to continue the tour operations for a five-year period at no cost to the
City,
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm (Springs
as follows:
Section 1. That the proposal from Desert Adventures, Inc. , dated May 28,
1991, is hereby accepted with the exception that Paragraph 1
of the proposal'shall be modified to reflect a lease-purchase
option with monthly payments applied to the purchase price,
and a "buy-out" provision at the end of the five years.
Section 2. That the proposal from Desert Adventures, Inc. , dated May 28, ,
1991, falls within the non-public project contractual services
provisions of the Palm Springs Municipal Code, Section
3. 12. 280, and therefore does not require competitive bidding.
Section 3. That the City Attorney is hereby authorized to prepare the
necessary documents to implement the proposal.
