OF THE CITY COUNCIL OF THE CITY OF
PALM SPRINGS, CALIFORNIA SETTING
TIME AND PLACE FOR PUBLIC HEARING ON
NECESSITY TO ORDER ACQUISITION BY
EMINENT DOMAIN PROCEEDINGS
WHEREAS the City of Palm Springs has beetn actively engaged in the
acquisition of certain lands for the construction and installation
of traffic signals at the intersection of Sunrise Way and Tachevah
Drive; and
WHEREAS it is necessary that certain land acquisition be made in
order to start construction as scheduled in June, 1991; and
WHEREAS at this time the City is desirous of setting a time and
place for public hearing on the necessity to acquire the needed
land not yet acquired for the said projects.
NOW THEREFORE BE 3:T RESOLVED by the City Council of the City of
Palm Springs, as follows:
Section 1. That the above citations are all true and correct.
Section 2 . That certain land acquisition necessary for the
accomplishment of the traffic signal project at the
intersection of Sunrise Way and Tachevah Drive is
described in Exhibit "A" and shown on the map
attached hereto and made a part hereof.
Section 3 . That notice is hereby given that on Wednesday, June
5, 1991, at the hour of 7 : 30 o'clock p.m. in the
City Council Chambers at 3200 Tahquitz Canyon Way,
_ Palm Springs, any and all persons whose land is to
be acquired will have an opportunity to appear and
to be heard on the matter of the necessity to
exercise the right of eminent domain to acquire
land necessary for the proposed construction and
installation of traffic signals at the intersection
of. Sunrise Way and Tachevah Drive. All persons
objecting to the public interest and necessity for
" the project and the determination as to whether or
not the project is planned or located in a manner
which will be most compatible with the greatest
public good and the necessity for the property to
be acquired should be present at said time and
place, if they wish to be heard, pursuant to
sections 1245. 235 of the Code of Civil Procedure.
Section 4 . Staff is hereby directed to notice the property
owners concerning adoption of the Resolution of
Necessity as required by Code of Civil Procedure,
Section 1240. 030 and 1245. 235.

YOU ARE HEREBY NOTIFIED that on Wednesday, June 5, 1991 at the hour
of 7 : 30 o'clock p.m. in the City Council Chambers at 3200 Tahquitz
Canyon Way, Palm Springs, California, the City Council of the City
of Palm Springs will hold a public hearing to determine the
following matters:
A) Whether the public interest and necessity require the
;acquisition of the above described real property for the
public projects to wit:
('-'P No. 89-09, Sunrise/TacheVZLh Traffic Signals, File No. R-89-
076 and R-89-077
B) Whether the project is planned or located in the manner that
will be most compatible with the greatest public good and the
least private injuries;
C) Whether the property sought to be acquired is necessary for
the proposed projects.
YOU ARE ALSO NOTIFIED that if: you wish to appear and be heard at
said public hearing upon these issues set forth above, you should
file with the City Clerk within 15 days after the date of mailing
of this notice, a written request to be heard upon said issues and
then be present at the time and place of the hearing. Your failure
to file a written request to appear and be heard at the hearing may
result in your waiver of the right: to appear and be heard. This is
pursuant to Code Section 1240. 030 and 1245.235 of the Code of Civil
Procedure.
In accordance with the procedures of the Code of Civil Procedures,
Sections 1245. 235 (b) , this notice is given by certified mail with
return receipt on this day of , 1991,

addressed to the persons here and above set forth..
