OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA, UPHOLDING THE PLANNING COMMISSION
DETERMINATION 1.0.386 REGARDING INCREASING THE
SALES AREA AT THE FULL SERVICE CARWASH SERVICE
STATION AT 4144 E. RAMON ROAD.
WHEREAS the City Council of the City of °Palm Springs has considered an
appeal by Lowell Wooden on property located at 4144 E. Ramon Road; and
WHEREAS the Planning Commission on February 27, 1991, at a duly noticed
meet•Ing determined that a sales area in excess of the 25 square feet allowed
for automobile service stations is not consistent with the Zoning Ordinance;
and
14HEREAS at a duly noticed meeting on April 17, 1991, on said appeal the
City Council reviewed all evidence provided at the hearing including the
staff report dated April 3, 1991, and all other written and oral testimony.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Palm
Springs does hereby uphold the Planning Commission Determination 10.386
in accordance with the following findings:
1. That for automobile service station facilities the Zoning Ordinance
prohibits accessory or secondary non-automotive commercial uses except
those uses customarily incident to the service station use limited
to vending machine sales of soft drinks, coffee and tea, snacks,
cigarettes and maps.
2. That the service station is a primary use on the site.
3o That the Zoning Ordinance allows additional uses including incidental
sales other than those from a vending machine provided that the sales
area is 25 square feet or less.
4. That the 25 square foot limitation on sales area cannot be increased
by Determination.
5. That the Zoning Ordinances does not permit mini-marts in connection
with a car wash.
6. That the applicant may request a Planned Development District on the
basis that this is an unusual aggregation of uses with the full service
carwash with the service station.
7. That the Planning staff is directed to review the Zoning Ordinance
and propose any appropriate modifications concerning car washes in
conjunction with service stations and accessory uses including food
sales.
8. That filing fees are waived for this applicant if a reapplication for
the same use is made within 12 months.
