OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA APPROVING CASE 5.0144-PD-116-A, 140
APARTMENT UNITS LOCATED ON SUNRISE WAY/SAN RAFAEL
' DRIVE, 0-5 ZONE, SECTION 35.
WHEREAS the City has received an application by Coachella Valley Housing
Coalition for a Planned Development District for 140 low and very low units
located on Sunrise Way north of San Rafael Drive (the Project) ; and
WHEREAS the Planning Commission considered the Project at a duly noticed
public hearing held on March 27, 1991; and
WHEREAS the Planning Commission recommended approval with conditions as
outline in its Resolution No. 4120; and
WHEREAS the City Council held a duly noticed public hearing on April 17,
1991, on said project; and
WHEREAS the City Council has reviewed all evidence provided at the hearing
including the staff report dated April 17, 1991 and all other written and
oral testimony, and find the Project, subject to the conditions contained
herein consistent with the requirements of the ordinances of the City and
with State law.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Palm
Springs, California, after considering the evidence provided at the hearing
does hereby approve the Preliminary Planned Development District for property
f hereinabove describe in accordance with the following Findings and subject
to the following conditions:
SECTION 1. The City Council finds:
a. That an amended planned Development District is the proper
application for this project.
b. That the proposed development of 140 affordable apartment units
is a suitable and desirable use for the community.
c. That the proposed use is consistent with the General Plan
designation of CDL8. (Controlled Density Residential - 8 dwelling
units per acre) which was designed to created affordable housing
opportunities.
d. That the size (13.29 acres) and shape is adequate to accommodate
' the proposed use.
e. That Sunrise Way is adequately designed to accommodate any traffic
generated by this project.
f. That the site was purchased by the City to provide a range of
housing opportunities. The subject property will provide 140
units for low to very low income people.
g. That the conditions imposed are necessary to protect the public
health, safety and general welfare of the community.

SECTION 2. The Project is approved subject to following conditions; all
of which are to be satisfied prior to issuance of certificate
of occupancy unless otherwise specified: '
a. That all Development Committee conditions dated Marche 27, 1991
shall be met.
b. That all mitigation measures of the environmental assessment
for Case 5.0144-PD-116 shall be met.
c. That final development plans shall be submitted in accordance
with Section 9403.00 of the Zoning Ordinance,. -
d. That final development plans shall be submitted in accordance
with Zoning Ordinance requirements. '

e. That the proposed carport design shall be evaluated at a later
date.
f. That water control shall be utilized on all buildings with no
overhang in a design approved by the Planning Commission. '
g. That the espalier is an inadequate solutiion for screening of
meters and as a design detail and shall be restudied and approved
by the Planning Commission.
h. That the flat two-story elevations shall be treated with
landscaping, or block walls integral to the building as approved
by the Planning Commission.
i . That the typical yard enclosure and mechanical screens shall
be block walls and not chain link.
j. That the landscaping shall be checked for hardiness due to type
of project; that the plant lists be kept simple with low
maintenance materials. The landscaping plan shall be submitted '
to and approved by the Planning Commission.
k. That final development plans shall include a specific design
for the pool area that is adequate in the opinion of the Planning
Commission for the numbers using the pool with additional funding
found for enlarging the pool if it is not adequate.

m. That any other detailed recreational area for the children and
residents shall be reviewed in final development plans and
approved by the Planning Commission.
