HomeMy WebLinkAbout17439 - RESOLUTIONS - 3/6/1991 RESOLUTION NO. 17439 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, REVERSING THE PLANNING COMMISSION DENIAL OF CASE 5.0568-CUP AND APPROVING A RETAIL TIRE SALES AND INSTALLATION AND AUTO SERVICE FACILITY LOCATED AT 689 S. PALM CANYON DRIVE, C-2 ZONE, SECTION 23, AND FILING A NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT IN CONJUNCTION THEREWITH. WHEREAS the City Council of the City of Palm Springs has considered an application by Jerry Frankel for a conditional use permit for a Winston Tire Store, a retail tire sales and installation and auto service facility to hie located at 689 S. Palm Canyon Drive; and WHEREAS the Planning Commission on January 23, 1991 , at a duly noticed public hearing denied the proposed conditional use permit:; and WHEREAS at a duly noticed noticed public hearing helot on February 20, •- 1991 , after considering all oral and written testimony the City Council - reversed the decision of the Planning Commission. NOW THEREFORE BE IT RESOLVED that the City Council of the City of Palm Springs does hereby reverse the Planning Commission denial of the conditional use permit in accordance with the following findings: 1 . That a retail tire sales and installation and auto service facility located in a C-2 Zone is one for which a conditional use permit is authorized. 2. That this type of auto service facility is necessary and desirable for the development of the community and is in harmony with the goals and objectives of the General Plan and would not be detrimental to existing or possible future uses in the vicinity of the subject a proposal . 3. That the 18,119 square fool: site is adequate in size and shiape to - accommodate the 5,550 square foot building with the required parking setbacks and landscaping. 4. That the site is served by S. Palm Canyon Drive which upon requested dedication and improvements is adequate in design and size to handle the type and quantity of traffic expected to be generated by the facility. 5. That no significant environmental impacts were identified and those impacts which were identified can be mitigated. BE IT FURTHER RESOLVED that the City Council does hereby remand the application back to the Planning Commission to establish conditions consistent with the foregoing for property hereinabove described.
