HomeMy WebLinkAbout17380 - RESOLUTIONS - 1/2/1991 RESOLUTION NO. 17380 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT FOR AN UNMANNED TELEPHONE EQUIPMENT SWITCHING FACILITY LOCATED ON NORTH PALM CANYON DRIVE BETWEEN RACQUET CLUB ROAD/VIA OLIVERA, C-1 ZONE, SECTION 3. WHEREAS, the Planning Commission has considered an application by GTE of California for a conditional use permit for an unmanned telephone equipment switching facility; and WHEREAS, the Planning Commission recommends approval with conditions as outlined in its Resolution No. 5002; and WHEREAS, the City Council is in agreement with the recommendation of the Planning Commission; and WHEREAS, it has been determined that there are certain requirements as dictated by ordinance of the Palm Springs City Council and by law of the State of California; and NOW THEREFORE BE IT RESOVLED that the City Council of the City of Palm Springs, California, does hereby approve a conditional use permit for the property described hereinabove, based on the following findings and subject to the following conditions: FINDINGS: 1. That the proposed project is one for which a conditional use permit is authorized by the Zoning Ordinance and is consistent with the Zoning Ordinance requirements. 2. That the use is in harmony with the various elements of the General Plan and is not detrimental to the existing or future uses in this zone. 3. That the proposed use being an unmanned facility subject to the proposed conditions, is not detrimental to the general public health, safety, or welfare. 4. That access to the facility from Palm Canyon Drive is not essential . CONDITIONS: ` 1. That all conditions of Development Committee dated December 12, 1990, be met. 2. That the proposed development shall conform to all applicable regulations of the Palm Springs Zoning Ordinance, Municipal Code, or any other City codes, ordinances, or resolutions ` which supplement the zoning district regulations. e CASE 5.0 Y/.05 67-CUP January 2, 1991 Page 2 3. That final landscape, irrigation, and exterior lighting plans shall be submitted for approval by the Planning Commission prior to issuance of a building permit. Landscape plans shall be approved by the Riverside County Agricultural Commissioner' s Office prior to submittal . 4. That access to the facility be provided from the alley along the rear of the property. No drive access to North Palm Canyon shall be alVowed. ADOPTED this 2nd day of January 1991.
