HomeMy WebLinkAbout17325 - RESOLUTIONS - 11/7/1990 RESOLUTION NO. 17325 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING THE LEVYING OF AN ANNUAL ASSESSMENT FEE FOR FISCAL YEAR 1990-91 IN THE DOWNTOWN BUSINESS IMPROVEMENT DISTRICT. WHEREAS the Parking and Business Improvement Area Law of 1989 (Street and Highways Code Sections 36500 et seg) allows for the levy of an assessment fee on all businesses conducted within the Downtown Business Improvement District; and WHEREAS no changes are recommended by the Board of the Downtown Business Improvement District in the boundaries of the District, the basis and method of levying assessments or the classification of businesses for the District's 1990-91 fiscal year; and WHEREAS on October 3, 1990 the City Council adopted a Resolution of Intention to levy an annual assessment for 1990-91, and adopted the annual report of the District, which report is on file with the City Clerk and adopted herein by reference; and �- WHEREAS the report of the District describes the improvements and activities to be provided for fiscal year 1990-91, estimates the cost of such improvements and activities to be $175,040, and, taking all contributions and carry overs into account, estimates the additional funds needed to be $158,260; and WHEREAS the City's Department of Finance has established that the total estimated assessments for the Downtown Business Improvement District's 1990-91 fiscal year to be $158,260; and WHEREAS on October 17, 1990, the City Council held a duly noticed hearing to consider the amount of the assessment to be levied for 1990-91, which hearing was continued to October 30, 1990; and WHEREAS at said hearing the City Council received oral and written protests from the owners of businesses in the District; and WHEREAS the total dollar amount of written protests received protesting the levying of the assessment is $70,550 of the above assessments; and WHEREAS the amount of assessments levied are based on the assessment formula attached hereto as Exhibit A and incorporated herein by this reference. NOW THEREFORE be it resolved that the City Council of the City of Palm Springs, California, finds that the valid protests received and not withdrawn at the hearing represent 44.6% of the total assessments proposed to be levied in the District, and that it declares that assessment fee shall be levied for fiscal year 1990-91 in the Downtown Business Improvement District.
