RESOLUTION NO. 17271
OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA, AUTHORIZING MODIFIED CONTRACTUAL
AGREEMENT WITH RIVERSIDE. COUNTY TO CONTINUE
PARTICIPATION IN THE CAL.IFORNIA IDENTIFICATION
SYSTEM/REMOTE ACCESS NETWORK.
WHEREAS, The California Identification System is being expanded to include
additional means of identifying criminal suspects; and
WHEREAS, the regional board representing the Counties of Riverside and
San Bernardino has approved the expanded system; and
WHEREAS, the costs of the Regional System will continue to be allocated
in proportion to populations within user ,jurisdictions in the aforesaid
counties with each county contributing fifty percent (50%).
WHEREAS, the City of Palm Springs desires to continue to participate in
and fund its prorated costs for the California Identification System.
NOW THEREFORE BE IT RESOLVED that the City of Palm Springs agrees to enter
into a modified contract with Riverside County to continue participation
in the California Identification System/Remote Access Network.

Effective 7/1/90, no Police Safety Unit employee shall
accumulate compensatory time in excess of sixty (60) hours. An
employee who has accumulated the maximum amount of compensatory
time shall not work overtime on a compensatory time basis until
the accumulation has been reduced to less than the maximum
accumulation allowed under these Rules. (16840, 7/11/89)
Section 7. That Section 5.12.4 be amended as follows:
5.12.4 Emergency Call-back Pay for Fire Safety Employees
When Fire Safety Unit employees are retained or called out and
work as a result of emergencies, such time spent on emergencies
shall be compensated at a rate of fifty percent (50%) above
the employee's regular hourly rate of pay. Emergency call-back
time shall be paid rather than accrued as compensatory time
off. Such emergency call-back or retention time shall not be
eligible for additional premium compensation as provided in
Rule 5.10, Subsection 4. "Emergencies" sha'II be defined as
engaging or combating fires, floods, accidents or involvement
r in other disaster operations, but shall not include coverage
for minimum staffing or regularly scheduled or pre-scheduled,
non-emergency work or duty time. Fire Safety Unit employees
` responding to emergency call-backs shall be compensated for
their travel time up to a maximum of one hour. (15994; 16341)
Section 8. That Section 5.15 be added and existing section 5.15 and 5.16
be renumbered follows:
5.15 Court Cancellation
If a subpoena of the type referred to in Rule 5.14, above is
-� cancelled less than twenty-four (24) hours prior to the
scheduled appearance or the end of the employee's last shift
prior to the scheduled appearance time, whichever is later, the
employee shall be paid a cancellation fee of $25.00. Employees
are required to ca'I'I in to the designated court liaison officer
(or the officer's designated backup) to determine whether or
not the subpoena has been cancelled. If an employee fails to
call in within sufficient time to avoid a cancellation fee, no
fee shall be paid if the subpoena had in fact been cancelled
and the information was available from the liaison officer.
Similarly, no court pay shall be paid under Rule 5.14 if the
employee was notified of the cancellation or if the employee
was notified of the cancellation or if the employee failed to
call in and the subpoena had in fact been cancelled. (16840,

5.16 Termination Pay
When a person separates from City employment, the employee
shall be paid for all compensation due. An employee terminated
by the City as a result of dismissal , release for unsatis-
factory probation or layoff shall be paid all compensation due
on the effective date of termination. No severance pay in lieu
of notice of termination shall be permitted.
5.17 Pay Periods
Pay periods shall be bi-weekly (twenty-six per year) ; each
begins at 12:01 a.m. Sunday and ends at 12:00 midnight the
second Saturday thereafter. Wages shall not be withheld for
more than six (6) days following the close of a pay period.
Payday shall be on the Friday following the end of each pay
period.

Section 9. That Section 6.7.2 be amended as follows:
6.7.2 Annual Leave Cash-In
In July and December of each year, employees in Groups II and
III shall have the option of converting accrued and vested
annual leave into cash. Such conversion may be for any amount
of accrued and vested annual leave hours, provided that the
employee has used the required minimum 80 hours (or 112 hours
for Group II Fire Safety Shift employees) of annual leave OR
maintains a bank of annual leave hours adequate to be able to
use the required minimum number of hours of annual leave by the
end of the calendar year, as provided in 6.7.,1.
Section 10. That Section 6.8.3 be added and 6.8.4 and 6.8.5 be amended and
renumbered as follows:
6.8.3 Annual Leave Cash-In
Employees in the Police Safety unit who use at least eighty
(80) hours of annual leave per year may request payment for up
to a total on one hundred twenty (120) hours of annual leave
per year in lieu of time off. Such cash-ins of annual leave
shall be permitted twice per year on dates designated by the J

6.8.4 Annual Leave Conversion Before Service Retirement
Effective July 1, 1989, Police Safety employees shall be
allowed, for PERS purposes, to convert up to one hundred fifty
(150) hours of annual leave which otherwise would accrue to
compensation, subject Ito PERS, during the twelve (12) month
period prior to a service (non-disability) retirement.
Effective July 1, 1991„ up to one hundred eighty (180) hours
may be so converted. Employees who decide to convert annual
leave time to compensation subject to PERS shall request such
conversion in writing to the Personnel Officer no less than one
year (1) in advance of the service retirement. (15994 ; 16341 ;

6.8.5 Maximum Accrual
Annual leave shall accrue to a maximum of two hundred sixteen
(216) hours. (16341; 16549, 8-9-88)
Section 11. That Section 6.9.11 and 6.9.7 be amended as follows: I
6.9.4 Annual Leave Carry-Over
The carry-over of accrued annual leave hours from ore fiscal
year to the next shall be granted only after a written request
is approved by the Fire Chief. However, vacation hours shall
not accrue beyond the maximum of fifteen (15) shifts (three
hundred sixty (360) hours) or two hundred fifty-seven and
fourteen hundredths (257.14) hours for Group I Fire Safety
employee assigned to a forty (40) hour work week.
6.9.5 Annual Leave Conversion Before Service Retirement
Fire Safety Unit employees shall be allowed, for PERS purposes,
to convert up to 120 hours of annual leave which otherwise
would accrue to compensation subject to PERS during the 12
month period prior to a service (non-disability) retirement.
Employees who decide to convert annual leave time to
compensation, subject to PERS, shall request such conversion in
writing to the Personnel Officer no less than one year in
advance of the service retirement. (15994)

6.9.7 Annual Leave While on Occupational Injury Leave
An employee who is on an occupational injury leave and reaches
the maximum annual leave accrual may request a temporary
lifting of the maximum 360 hour accrual by giving written
notice to the Chief. In such cases, the employee shall be
permitted to continue to accrue annual leave over 360 hours
from the time such notice is given until the next regular
annual leave cash out date. On said next regular annual leave
cash out date, the employee must cash out at least al'I annual
leave in excess of 360 hours or he will 'lose such excess hours.
The employee will not be entitled to accrue annual 'leave in
excess of 360 hours on and after the date of said next regular
annual leave cash out date. Employees on occupational injury
leave may cash out their annual leave without regard for the
requirement of using eight (80) or, for shift employees, one
hundred twelve (112) hours annual leave. This paragraph shall
apply on a per injury basis.
Section 12. That Section 6.14.4, 6.14.5, and 6.14.9 to be amended as
follows:
6.14.4 General Leave General Provisions
` General leave must be approved by the department head. For
purposes of computing general leave usage regularly assigned
days off shall not be counted as "working days." General leave
shall be paid at the employee's straight time hourly rate of
pay in effect during the leave program. Employees shall be
eligible to use general leave after the successful completion
of the initial probationary period. Dispatcher I and
Dispatcher II incumbents shall be eligible to use General Leave
after the completion of 6 months.
6.14.5 Maximum Accrual and Minimum Use
General leave shall accrue to the credit of an eligible
employee up to, but not to exceed a maximum accrual of four
hundred sixteen (416) hours. (15994, 9-3-86)
During each calendar year, each General Unit employee shall use
at 'least forty (40) consecutive hours of General Leave and
shall make a request for said leave to the department head in
sufficient time to plan work schedules. Consequently,
department heads are responsible for planning work schedules to
allow each General Unit employee to take forty (40) consecutive
hours of General Leave each calendar year and each employee is
responsible for using forty (40) consecutive hours of general
leave each calendar year. Failure to use at least forty (40)
consecutive hours of general leave shall result in City Manager
a review of the circumstances surrounding such failure. Regular
General Unit and Confidential employees who work 20 hours or
less per week shall use twenty (20) consecutive hours of
general leave as provided herein. (15994)
6.14.9 General Leave Cash-In
In July and December of each year, General Unit and
Confidential employees shall have the option of converting
those hours of accrued and vested general leave in excess of
180 hours into cash. Such conversion to cash shall not exceed
a total of two hundred (200) hours in a calendar year. Regular
General Unit and Confidential employees who work 20 hours or
less per week may convert those hours of accrued and vested
general leave in excess of 90 hours into cash. Such conversion
shall not exceed a total of 100 hours in a calendar year.

Section 13. That Section 6.18.4 be amended as follows:
6.18.4 Time Off With Pay
Effective July 1, 1991 , Police Safety Unit employees who are
called to temporary military duty will be given maximum of
twenty (20) days off with pay per calendar year. Any leave in
excess of twenty (20) days shall be without pay. (15621)
Section 14. That Section 6.25.6 be added as follows:
6.25.6 Police Safety Unit EmLoyees
Police Safety Unit, employees may use comp time or annual 'leave
in the event of a death in the immediate family.
Section 15. That Section 9.2.1. and 9.2.6 be amended as follows:
9.2.1 Certification of Eligibles
Upon receipt of notification of a vacancy, the Personnel
Officer shall :
(1) in the case of selection by competitive examination,
certify the applicable eligibles in the order of rating
bands which are determined by ratings on the examination(s)
and submit to the department head; the number and size of
the rating bands certified shall be determined as deemed
appropriate by the Personnel Officer.
9.2.6 Certification for Student Appointments
Students may be certified for employment connected with their
studies in the same manner as certification for regular
employment. Where placement involves a particular discipline,
special procedures not necessarily provided for in Rule 9.2.1,
may be used. Any, special procedure for a particular class or
classes will be outlined by the Personnel Officer in the
examination announcement for student employment.
Section 16. That Section 11.2 be amended as follows:
11.2 Length of Probationary Period
The probationary period shall normally be one year for Police
and Fire Safety employees and for Dispatcher I and Dispatcher
II , and six months for a'lI other employees. An employee shall
automatically be deemed to have passed probation at the end ' of
the normal probationary period unless the department head has
submitted in advance to the Personnel Officer a written request
with justification for one of the following:
Section 17. That Section 13.6„7 be deleted.
Section 18. That Section 14.2„3 be amended as follows:
14.2.3 Response to Notice of Charges
Within five (5) working days of receipt of the Notice of
Charges, a regular employee has the option to respond to them
either orally or in writing to the employee's department head.
Upon a written request, an extension of up to five (5) working
days within which to respond may be grunted by the above
mentioned City authority. The purpose of this response is to
