RECOMMENDATION: That the City Council approve the Sixth Amendment to Contract Services Agreement No. 3827 with Tait &Associates, Inc., for design services in an amount not to exceed $6,440.00, Underground Storage Tank Removal and Replacement, City Project 95-17. BACKGROUND: On July 15, 1997, City Council approved Agreement No. 3827 with Tait & Associates, Inc., for the preparation of design, specifications and engineer's estimate for the removal and replacement of the underground fuel tanks at seven sites throughout the City. In 1973, EPA issued the Oil Prevention Regulation, which is codified at 40 CFR Part 112 Abstract, to address the oil spill prevention provisions contained in the Clean Water Act of 1972. The regulation forms the basis of EPA's oil spill prevention, control and countermeasures, or SPCC program, which seeks to prevent oil spills from certain aboveground and underground storage tanks. In particular,the regulation applies to non-transportation-related facilities that 1) Have an aboveground storage capacity of more than 660 gallons in a single tank, an aggregate aboveground storage capacity of more than 1,320 gallons or a total underground storage capacity of 42,000 gallons and 2) Could reasonably be expected to discharge oil in harmful quantities into navigable waters of the United States. The regulation requires each operator or owner of a regulated facility to prepare an SPCC Plan. The Plan is required to address the facility's design, operation and maintenance procedures established to prevent spills from occurring, as well as countermeasures to control, contain, clean up and mitigate the effects of an oil spill that could affect navigable waters. EPA proposed revisions to the Oil Pollution Prevention regulation in two phases. EPA proposed its first set of revisions to the regulation on October 22, 1991. These proposed revisions, in addition to strengthening and clarifying previous regulatory language, outline the additional requirements for regulated oil storage and handling facilities. On July 1, 1994, EPA finalized a second set of revisions to the Oil Pollution Prevention regulations. The revisions incorporated the new requirements added by the Oil Pollution Act of 1990 that direct facility owners or operators to prepare, and in some cases submit to the federal government, plans for responding to a worst-case discharge of oil. Per the above EPA regulations, the City is to submit a Spill Prevention, Control and Countermeasure Plan (SPCC)for the four(4) locations listed below. This work was not included in the original scope of services with Tait & Associates because this ?A Amendment No. 6 for Tait &Associates, CP No. 95-17 September 6, 2000 Page 2 of 2 this plan was not required during the design and their scope of services to the City didn't include this work. This plan includes the following task for each site: 1. Data Review 2. Field Work - Site Inspection and Personnel Interviews 3. Spill Prevention, Control and Countermeasure Plan (SPCC) 4. Project Management and Professional Engineer Certification The four (4) locations are: 1885 Golf Club Drive 4375 Mesquite Avenue 3200 East Tahquitz Canyon 425 North Civic Drive These locations contain new above ground tanks, recently installed under City Project 95-17. The cost for these four plans are $6,000.00 ($1,500.00 x 4). Secondly, additional time for consultation was added to resolve fueling problems to the following sites: 425 North Civic Drive 1885 Golf Club Drive Ave 34 Lift Station The cost for this construction administration is $440.00 (5.5 hrs. x $80.00) Funds are available in account number 001-4201-43200(Contractual Services)and 420-6800-50000 (WWTP Unscheduled Capital Projects) _P�vs DAVID J. BARAKIAN City Engineer APPROVED: j,City Manager Attachment: Minute Order Sixth Amendment to Agreement No. 3827 REVIEWED BY DK OF FINANCE -171 O ?d Z- AMENDMENT NO. 6 TO AGREEMENT NO. 3827 FOR DESIGN SERVICES OF UNDERGROUND FUEL STORAGE TANKS CITY PROJECT NO. 95-17 The following article of Agreement No. 3827 is hereby amended to read as follows: 1.01 SECTION 2.1, Contract Sum, is hereby amended to provide a maximum contract amount of$127,799.00, an increase of$6,440.00. 2.0 EXHIBIT"A", Scope of Services, is hereby amended as follows: Task A Submit a detailed spill prevention, control and counter-measure plan (SPCC) for each of the following locations: 1885 Golf Club Drive (WWTP / Lift Station) 4375 Mesquite Avenue (WWTP) 3200 East Tahquitz Canyon (Civic Center) 425 North Civic Drive (City Hall) The spill prevention, control and counter-measure plans shall include the following for each location: Data Review Field Work- Site inspection and personnel interviews Spill prevention, control and counter-measure plan and recommendations preparation Project management and professional engineer certificate Task B Consultation with City Staff to resolve fueling problems at the following sites: 425 North Civic drive - Breakaway fuel dispensers were not functioning correctly 1885 Golf Club Drive - Day tank for the generator was not receiving the correct amount of fuel from the above ground tank Ave. 34 Lift Station - Day tank was added to enable the generator to start in the event of an emergency 3.0 EXHIBIT "C", Schedule of Compensation is hereby amended by adding the following: SPCC $1,500.00 x 4 each = $6,000.00 Consultation $80.00 x 5.5 hrs. _ $ 440.00 Total not to exceed $6,440.00, payable upon satisfactory completion of each task or approved portion thereof. All services shall be performed upon authorization by the City. Except as specifically amended by this Sixth Amended, all terms and provisions of Agreement No. 3827, approved by the City Council on July 16, 1997, Minute order No. 5998, remains in full force and effect.
