HomeMy WebLinkAbout17243 - RESOLUTIONS - 9/5/1990 RESOLUTION NO. 17243 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA AMENDING THE GENERAL PLAN NOISE ELEMENT AND INCORPORATING THE PALM SPRINGS REGIONAL AIRPORT FAR PART 150 NOISE COMPATIBILITY STUDY AS A TECHNICAL APPENDIX C. WHEREAS, the Planning Commission has reviewed and is recommending approval of the proposed amendments to the General Plan Noise Element including and incorporating the FAR Part 150 Noise Compatibility Study as Technical Appendix C; and WHEREAS, the City Council adopted the existing General Plan Noise Element at its October 2, 1974 meeting per Resolution No. 11199; and WHEREAS, the Planning Commission has recommended certification of Final Environmental Impact Report/Environmental Assessment for the proposed General Plan Amendments in accordance with the California Environmental Quality Act and the National Environmental Policy Act; and WHEREAS, the City Council has reviewed and considered the information contained in the Final Environmental Impact Report/Environmental Assessment; and WHEREAS, the Planning Commission and City Council have held public hearings in accordance with State and local laws; and WHEREAS, the proposed amendments to the Noise Element regarding airport noise are based upon the recommendations of the FAR Part 150 Noise Compatibility Study; and WHEREAS, the city Council is in agreement with the recommendation of the Planning Commission. NOW THEREFORE BE IT RESOLVED that the City Council of the City of Palm Springs, California, does hereby approve the proposed amendments to the General Plan Noise Element text and does hereby incorporate the FAR Part L50 Noise Compatibility Study as Technical Appendix C which are incorporated herein by reference and shall remain on file in the Office of the City Clerk. 13E IT FURTHER RESOLVED that the City Council of the City of Palm Springs, California, does hereby certify the Final Environmental Impact Report/Environmental Assessment as complete and adopts the following findings: FINDINGS: 1. That the Final Environmental Impact Report/Environmental Assessment (Final EIR/EA) for the Noise Compatibility Program, General Aviation Runway and Terminal Development Plan for Palm Springs Regional Airport has been completed in compliance with the California Environmental Quality Act and the National Environmental Policy Act. 2. That the subject Final EIR/EA was presented to the Planning Commission and the Planning Commission considered the information contained in the Final EIR/EA prior to approving the project. 3. That continued growth within the Coachella Vallley will result in an ' increase in aviation traffic: even if the subject projects including the Airport Specific Plan, Noise Compatibility Program, General Plan Amendments, Terminal Expansion and parallel runway are not approved. r F 4. That the City considered and submitted to the FAA a proposal which would re-direct flight patterns and restrict evening commercial air carriers to Stage 3 aircraft and upon review of these proposals the FAA rejected such restrictions. 5. That the noise related impacts which were identified as being potentially significant during the environmental assessment process have been fully evaluated and that the recommended Noise Compatibility Plan, Airport Specific Plan, Aviation Noise Abatement Program, Land Use Management Plan and Implementation Plan will substantially lessen most of the potentially significant environmental impacts to a level acceptable within the community. 6. That the cumulative traffic impacts to four roadway intersections may be considered significant even though airport related traffic represents a minor percentage increase in overall traffic. Mitigation measures are being recommended which will reduce airport related impacts to the extent feasible. 7. That cumulative air quality impacts are considered significant and that where possible mitigation measures and programs will be implemented. Furthermore, as specific regional Air Quality Management District air pollution control measures are implemented the Palm Springs Regional Airport will comply. 8. That air quality impacts resulting from the operations of aircraft are beyond the authority of the City of Palm Springs and must be addressed at the regional , State or Federal levels. 9. That the Planning Commission finds that the significant and cumulatively significant impacts including traffic, air quality which cannot be fully mitigated are found to be acceptable within the community because of the economic benefits of providing regional airport facilities for the City of Palm Springs and surrounding communities. 10. That the project alternatives have been considered during the decision making process and options which include abandoning the Noise Compatibility Plan, not providing a general aviation runway, not expanding the terminal , alternative noise abatement measures, alternative take-off patterns, mandating Stage 3 aircraft, and other measures were considered and found to be infeasible. 11. That alternate airport locations have been evaluated in the Noise Compatibility Plan and Final EIR and have been rejected as not meeting project objectives or have been rejected by the Federal Aviation Administration.
