OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA, APPROVING CASE TTM 25964, FOR A 69
UNIT SINGLE-FAMILY RESIDENTIAL SUBDIVISION
LOCATED ON INDIAN LAND BETWEEN SAN RAFAEL ON THE
NORTH AND FRANCIS DRIVE ON THE SOUTH, R-1-C
ZONE, SECTION 2.
WHEREAS, the Planning Commission has considered an application by
Bayless/Elfsten for approval of a Tentative Tract Map for a 69 unit single-
family residential subdivision; and
WHEREAS, the Planning Commission recommends approval of this Tract Map sub-
ject to conditions as outlined in Resolution No. 4082; and
WHEREAS, the Planning Commission finds that the proposed map is consistent
with the General Plan of the City of Palm Springs; and
WHEREAS, the City Council is in agreement with the recommendations of the
Planning Commission.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Palm
Springs, California, does hereby approve Tentative Tract Map 25964 subject
to the subject findings and conditions:
Findings:
1. That the proposed project at the location set forth in the applica-
tion is properly one for which a tentative tract map is authorized
by the Zoning Ordinance.
2. That the use is in harmony with the various elements of the General
Plan and is not detrimental to existing uses or future uses speci-
fically permitted in this zone.
3. That the proposed use is not detrimental to the general public
health, safety, or welfare.
4. That the addition of 69 single-family homes and the increase in
associated vehicular traffic will not impact the affected roadways
in a negative manner.
5. That the proposal is consistent with the intent of the General
Plan, and that the deletion of Via Miraleste will not affect the
General Plan nor affect the traffic circulation network.
6. That a Negative Declaration of Environmental Impact, with mitiga-
tion measures, has been filed.
Conditions:
1. That the proposed development of the premises shall conform to all
applicable regulations of the Palm Springs Zoning Ordinance, Muni-
cipal Code, or any other City codes, ordinances, and resolutions
which supplement the zoning district regulations.
2. That final landscape, irrigation, exterior lighting, and fencing
plans be submitted for approval by the Planning Commission prior to
issuance of a building permit. Landscape plans shall be approved
by the Riverside County Agricultural Commissioner's Office prior to
submittal .

3. That all conditions of the Development Committee (minutes dated
June 21, 1990) be implemented.
4„ That the applicant shall submit within 30 days of approval , details
of the Sims Road closure at Via Miraleste. These details shall
include driveway approach details to the affected residence.
5„ That all grading operations be conducted in strict compliance with
Chapter 70 of the Uniform Building Code. A specific wind erosion
control program shall be submitted with the grading and shall be
approved prior to issuance of grading permits. Specific provisions
which shall be included in the plan include on-site watering,
temporary irrigation systems, phasing of improvements, construction
of public streets, and construction of all perimeter walls early in
Phase I.
6. That the developer submit for approval by the City, CC&R's that
will identify liability of landscape maintenance.
7. That the setback to the Francis Drive perimeter wall be increased
to average 25 feet, or that, a 4, foot wall be provided.
8. That a 10 foot yard setback is approved where garages are turned
away from the street only. All other front yard setbacks shall be
20 feet or greater.
9. Landscape Plan shall include substitution of African Sumac Trees
for Carob Trees. Trees shall be deep watered and incorporate use
of root guards.
10. A swale shall be incorporated into the landscape design to contain
irrigation runoff onto right-of-way.
11. Wall details to be submitted with final landscape plans.
