HomeMy WebLinkAbout17237 - RESOLUTIONS - 9/5/1990 i RESOLUTION NO. 17237 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING TENTATIVE PARCEL MAP 25791 FOR A FOUR LOT SINGLE FAMILY RESIDENTIAL SUBDIVISION LOCATED ON THE NORTHEAST CORNER OF PASEO EL MIRADOR AND VIA DONNA, R-1AH ZONE, SECTION 11. WHEREAS the Planning Commission has considered an application by Newport Land and Development, Inc. for approval of a tentative parcel map for four lot single family residential subdivision; and WHEREAS the Planning Commission recommends approval of this tentative parcel map subject to conditions as outlined in Resolution No. 4086; and WHEREAS the Planning Commission finds that the proposed map is consistent with the General Plan of the City of Palm Springs; and WHEREAS the City Council is in agreement with the recommendations of the Planning Commission. NOW THEREFORE BE IT RESOLVED that the City Council of the City of Palm Springs, California, does hereby approve Tentative Parcel Map 25791 subject to the following findings and conditions: FINDINGS: 1. That the subject property is irregular in shape thus requiring modification of the lot dimensions and the minimum lot area requirements. 2. That the conditions of approval have been imposed which will cause the subject development to conform to property development standards in the neighborhood. 3. That the granting of a variance for substandard lot dimensions and reduced lot area and the approval of the tentative parcel map will not be detrimental to the public health, safety, convenience, welfare or injurious to the property and improvements in the neighborhood. 4. That the granting of a variance and approval of the tentative parcel map will be consistent with the General Plan insofar as the type of land use and building density. 5. That the tentative parcel map and variance are categorically exempt from the CEQA. 6. That the 1.85 acre site and proposed residential lots are adequate in size and shape even with the requested variance for lot width, depth and lot area to accommodate said residential uses including yards, setbacks, walls, fences and other accessory improvements to adjust said use to the neighborhood. TPM 25791 September 5, 1990 Page 2 CONDITIONS: 1. The proposed development of the premises shall conform to all applicable regulations of the Palm Springs Zoning Ordinance, Municipal Code, or any other City Codes, ordinances and resolutions which supplement the zoning district regulations. 2. Submit an erosion control program in conjunction with the final grading plan. At a minimum, Chapter 70 UBC erosion control measures shall be required during site construction. A hydroseed program with temporary irrigation shall be implemented prior to final inspection of on-sine improvements. 3. The pad elevations shall be established at the minimum necessary to accommodate positive site drainage and sewer flows. 4. Submit an existing tree inventory and disposition program. Remove all tamarisk trees within 25 feet: of the public right-of-way. 5. That all recommended conditions of approval outlined in the ' July 25, 1990, Development Committee conditions be complied with. ADOPTED this 5th day of September 1990.
