HomeMy WebLinkAbout17173 - RESOLUTIONS - 6/20/1990 RESOLUTION NO. 17173 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, INITIATING PROCEEDINGS, MAKING FINDINGS ON PETITION AND MAKING APPOINTMENTS IN AN ASSESSMENT DISTRICT WHEREAS, the CITY COUNCIL of the CITY OF PALM SPRINGS, CALIFORNIA, has been presented by certain propertyowners an executed Petition requesting the construction of certain public improvements, together with appurtenances and appurtenant work in connection therewith, said improvements to be constructed pursuant to the terms and provisions of the "Landscaping and Lighting Act of 1972", being Division 15, Part 2 of the of the Streets and Highways Code of the State of California, in a special assessment district known and designated as "PARKWAYS MAINTENANCE DISTRICT NO. 8 (San Rafael Partnership) hereinafter referred to as the "Maintenance District" for the following work: To maintain the proposed landscaped parkways along the San Rafael Drive and Avenida Caballeros frontages of the "San Rafael Partnership" subdivision, Tract 24853-1 and Parcel Map 25864. Maintenance costs shall include labor and material costs for upkeep and maintenance and any replacement of the irrigation system, lawn, trees, plants and any and all work necessary to keep the green belt area referenced above in good condition to serve and benefit the boundaries of the above project development. WHEREAS, it has been reported that said Petition contains the signatures of more than sixty percent (60%) of the property owners of the assessable area of the property to be subject to assessment for the proposed works of improvement. Said Petition meets the requirements of Section 2804, Division 4 of the Streets and Highways Code of the State of California; and WHEREAS, at this time, this legislative body is desirous of making the required appointments and designating persons to perform certain duties, in order to allow the proceedings to go forward to completion in accordance with the provisions of the law. NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS: SECTION 1. That the above recitals are all true and correct. SECTION 2. That it is hereby found that said Petition has been signed " by owners owning land constituting more than sixty percent (60%) of all assessable land within the boundaries of the proposed Assessment District. SECTION 3. That said Petition shall be filed with the transcript of these proceedings and shall remain open to public inspection. SECTION 4. That said Petition meets the requirements of Section 2804, Division 4 of the Streets and Highways Code of the State of California. SECTION 5. That the place for recordation of the assessment roll and diagram shall be in the Office of the Superintendent of Streets, and said assessment roll and diagram, upon recordation, shall be kept as a permanent record. SECTION 6. That the DESERT SUN is hereby designated as the newspaper for all publications as required by law and as necessary for completion of this Maintenance District. SECTION 7. That the City Contracts Administrator is hereby appointed the administrator for said proceedings, and said Contracts Administrator shall perform all of the duties and responsibilities as set forth by law as they relate to said Maintenance District. Resolution No, 17173 Page 2 SECTION 8. That the Contracts Administrator of the City of Palm Springs is hereby designated engineer of the work for the purpose of these formation proceedings. The Cit.), Council hereby directs the engineer of the work to prepare and file with the City Clerk a report in accordance with Article 4 of Chapter 1 of the Landscaping and Lighting Act of 1972. SECTION 9. That the cost of the improvements will be charged to the land which benefits from the improvements, including our land. SECTION 10. That a report will be prepared on the project, including a detailed cost estimate, and a division of the costs among the benefited parcels of land, and that the City will conduct a public hearing on the report, SECTION 11. That the cost of engineering, legal and other incidental expenses will be included in the project cost. SECTION 12. That the City Council hereby makes the expenses of said maintenance chargeable upon the District hereby declared to be areas of benefited by said maintenance and to be assessed to pay the costs and expenses thereof, said assessments to be collected as part of the property tax assessment by County Tax Collector's Office. SECTION 13. That property with an assessment lien is subject to foreclosure in cases of delinquency and non-payment. ADOPTED this 20th day of June, 1990.
