HomeMy WebLinkAbout17163 - RESOLUTIONS - 6/20/1990 RESOLUTION NO. 17163 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, TO PARTIALLY CLOSE EXISTING ROAD THROUGH-STREET PORTIONS OF FIESTA RD. , RODEO RD. , VAQUERO RD. AND OPUNTIA RD. (BETWEEN CHIA RD. , AND CHUCKWALLA RD. ) CONDITIONED UPON OVERRULING OF PROTEST AND APPROVAL OF THE INSTALLATION OF CUL-DE-SACS AND WALLS FOR ASSESSMENT DISTRICT NO. 159. - - - - - - - - - WHEREAS the City Council is authorized by Street Vacation Act of 1941, Part 3, Division 9, of the Streets and Highways Code (Sections 8300 et seq. ) , to vacate and close to public use streets or parts of streets within the limits of the City; and WHEREAS heretofore the City Council did adopt a Resolution declaring its intention to close the hereinafter referred to portions of Fiesta Rd. , Rodeo Rd. , Vaquero Rd. and Opuntia Rd. and did post notices as required by the Statute, and on June 6, 1990, did hold its public hearing as required by the Statute; and WHEREAS the City Council has found from all evidence submitted that those portions of Fiesta Rd,, , Rodeo Rd. , Vaquero Rd, and Opuntia Rd. as described in the Resolution of Intention, were and are unnecessary for present or prospective public street purposes, and that it is in the public interest that the hereinafter described public right-of-way be partially closed; NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs as follows: Section 1. That the City Council does hereby partially close existing through-street portions of Fiesta Rd. , Rodeo Rd. , and Opuntia Rd. , (between Chia Rd. and Chuckwalla Rd. ) for the purposes of installing cul-de-sacs and walls for the Assessment District No. 159 project as described in Exhibit "A", attached hereto and made a part hereof, as streets within the City of Palm Springs, County of Riverside, State of California, depicted on a map on file in the office of the City Clerk of the City of Palm Springs, California, which said map is hereby referred to for the particulars on the proposed street closure. Section 2. That said partial street closures are conditioned upon the overruling of protests and City Council approval of the work of . improvements pursuant to Assessment District No. 159. If said Assessment District is protested out and denied by City Council , this resolution is null and void; however if said Assessment District is approved by City Council , this resolution is effective on the date of the Assessment District No. 159 protest hearing. Section 3. That the City Clerk is directed to cause a certified copy of this Resolution, attested by her under the seal of the City, to be recorded in the Office of the County Recorder of Riverside County. The City Clerk is further directed to transmit a certified copy of this Resolution to the County Surveyor of Riverside County. (Conditional to Section 2 above). ADOPTED THIS 20th day of June 1990.
