HomeMy WebLinkAbout17137 - RESOLUTIONS - 5/16/1990 RESOLUTION NO. 17137 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, AMENDING THE TERMS AND CONDITIONS OF LICENSE AGREEMENT 42475 WITH DESERT TRANSPORTATION COMPANY, BHA DESERT CAB. WHLRL•AS the City Council granted License Agreement #247b to Desert Transportation Company, dba Desert Cab, on September- 1, 1987 for a five-year period; and WHEREAS Article 1V of said License Agreement states "Grantor and Grantee agree that the above rates shall remain in full force arid effect until such r time as the City Council authorizes changes" ; and WHEREAS, on June 1, 1989, the City Council granted a taxicab fare increase which was coupled to an increase in shift fees from 45% to SOY. of the meter; 1 and - WHEREAS shortly after the June 1989 rate increase the State of California ordered Desert Gab to swatch drivers from "contractual" to "employee" drivers which resulted in wages being based on minimum wage or 35% of the meter or a Ib% drop in shift fees, with the funds saved from reduction in shut tees to cover insurance, payroll taxes and gasoline costs; and WHEREAS, on January 23, 1990, Desert Cab submitted a request for a rate adjustment; and WHEREAS, in its review of the requested rate increase, City Council has fuun.i that demand for down-valley taxicab service and the resultant return to FaLm Springs with empty loads are placing a heavy strain on the ability of Desert Cab to provide the required service levels at a reasonable rate; and WHEREAS Article XV of said License Agreement allows L41e pity Counoil to modify the terms and conditions of the agreement in September of each ye.;s to ensure the public convenience and necessity is met, IJUW THEREFORE BE IT RESULVED by the City Council of the City of Palm Springs as follows: Section 1. That the rate increase of the per-mile rate from Sl, 85 to $2. 70 is hereby denied; ' '.section 2. That, effective September 15, 1990, the Airport is removed it om the area of exclusivity if, the License Agreement, and other properly licensed cab companies will be allowed to fail in line for a pickup at the Airport following the delivery of a passenger to the Airport and/or at any time there are four or less cabs at the Airport, said cab companies to have rates and charges similar to besert Cab; ,section J. 'That the modiiication of the License Agreement effective September lb, 1950, is hereby approved which provides time prior to actual implementation for the Licensee to present relevant facts as to why the action taken in Section 2, above, is not in the best interests of meeting the convenience and necessity of the citizens and visitors of Palm Springs.
