Home My WebLink About17121 - RESOLUTIONS - 5/16/1990 RESOLUTION NO. 17121 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, VACATING AND ABANDONING PORTIONS OF THE CATHEDRAL CANYON BICYCLE PATH EASEMENT IN SECTION 28, T.4S. R.5E. S.B.B. & M. WHEREAS the City Council of the City of Palm Springs, California, is authorized by the Public Streets, Highways and Service Easements Vacation law., Part 3, Division 9, of the Streets and Highway Code, to vacate and close to public use streets and easements or parts of streets and easements within the limits of the City; and WHEREAS heretofore the City Council did adopt a resolution declaring its intention to vacate and close the hereinafter referred to portions of the Cathedral Canyon Country Club Bicycle Path Easements and the City Council did post notice as required by the Statute, and did hold its public •1 hearings as required by the Statute.; and WHEREAS the City Council found from all evidence submitted that those portions of the Cathedral Canyon Country Club Bicycle Path Easements as described in the Resolution of Intention, was and is unnecessary for present or prospective public bicycle path purposes, and that it is in the public interest that the hereinafter described public bicycle path easements be vacated; and .. WHEREAS the Planning Commission determined that the vacation is in the best interest of the City and is not in conflict with the City' s General Plain. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs as follows: Section 1. The City Council does hereby vacate all the City' s right, title and interest in those portions of the Cathedral Canyon Country Club Bicycle Path Easements described in Exhibit "A" and depicted on Exhibit "B" attached hereto and made a part hereof, which lie within said City, County of Riverside, State of California, which said Exhibits "A" and "B" are hereby referred to for the particulars on the proposed easement vacation. Section 2. That the City Clerk is directed to cause a certified copy of this Resolution, attested to by the City Clerk under the seal of the City, to be recorded in the Office of the County Recorder of Riverside County. The City Clerk is further directed to transmit a certified copy of this Resolution to the County Surveyor of Riverside County. PARCEL 3: Being the 6.00 foot wide bicycle path lying within Lot A as shown on that map entitled "Tract Map No. 13792-3 being a portion of West one-half of Section 28 T.4S. R.5E. S.B.B. & M.", recorded on August 14, 1980 in Book 114 of Tract Maps at Pages 46 and 47, Records of Riverside County. PARCEL 4: Being the 6.00 foot wide bicycle path lying within Lot A as shown on that map entitled "Tract Map No. 13792-1 being a portion of the West half of Section 28, T.45. R. 5E. S.B.B. & M. " , recorded on September 21, 1979 in book 107 of Tract Maps at Pages 61 and 62, Records of Riverside County.
