HomeMy WebLinkAbout17102 - RESOLUTIONS - 4/18/1990 RESOLUTION NO. 17102 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DECLARING ITS INTENTION TO VACATE ALL OF THE RIGHT, TITLE, AND INTEREST OF SAID CITY IN PORTIONS OF THE CATHEDRAL CANYON COUNTRY CLUB BICYCLE PATH EASEMENTS IN SECTION 28, T.4S. R5E. S.B.B.&M. WHEREAS the City Council of the City of Palm Springs, California, is authorized by the Public Streets, Highways and Service Easements_, Vacation law, Part 3, Division 9, of the Streets and Highways Code of the State of California, to vacate and close to public use streets and easements, or parts of streets and easements, within the limits of said City; and WHEREAS the City Council intends to vacate and close to public use portions of the Cathedral Canyon Country Club Bicycle Path Easements, within said City, County of Riverside, State of California. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs as follows: Section 1. That the City Council does hereby signify and declare its intention to vacate a certain bicycle path easement in said City as described in Exhibit "A" and shown on Exhibit "B" , attached hereto and made a part hereof. Section 2. That the Director of Community Development of said City is ' hereby directed to conspicuously post along the line of the part of said bicycle path easement proposed to be vacated at not more than three hundred (300) foot intervals, but not less than three (3) in all , on said bicycle path easement, notice of bicycle path easement vacation. Such notices shall state passage of the Resolution of Intention and the time and place of hearing all persons interested in or objecting to the proposed vacation. , Section 3. That the 16th day of May, 1990, at the hour of 7:30 p.m. of said date, in the City Council Chamber at 3200 Tahquitz-McCallum Way, Palm Springs., California, be and the same is hereby fixed as the time and place for hearing all persons interested in or objecting to the said proposed bicycle path easement vacation, said time being not less than fifteen ( 15) days from the date of adoption of this Resolution. Section 4. That the City Clerk is hereby directed to cause this Resolution of Intention to be published in the manner prescribed by law for the publication of Ordinances of said City. ", recorded on August 14, 1980 in Book 114 of Tract Maps I' at Pages 46 and 47, Records of Riverside County. PARCEL 4: Being the 6.00 foot wide bicycle path lying within Lot A as shown on that map entitled "Tract Map No. 13792-1 being a portion of the West half of Section 28, T.4S. R. 5E. S.B. B. & M.
