OF THE CITY COUNCIL OF THE CITY OF
PALM SPRINGS, CALIFORNIA, APPROVING
A CHANGE OF LAND USE BY THE CULTURAL
CENTER OF PALM SPRINGS DBA PALM SPRINGS
PERFORMING ARTS CENTER.
WHEREAS, on May 4, 1984, the City Council adopted Resolution No. 15037 approv-
ing the raising of funds to acquire and hold approximately 35 acres of lease
land and approximately 5.7 acres of adjacent fee land for the development
of a convention center and a cultural arts center; and
WHEREAS, on May 21, 1986, the City Council adopted Resolution No. 15880
approving the execution by the Chairman of the Community Redevelopment
Agency of a Memorandum of Understanding with the Cultural Center of Palm
Springs for the development of a cultural arts center on the approximately
5.7-acre site adjacent to the convention Center (hereinafter, the "Adjacent
Site") ; and
WHEREAS, ON December 14, 1988 the City of Palm Springs Public Facilities
Corporation purchased the Adjacent Site; and
WHEREAS, the City of Palm Springs is desirous of expanding the Convention
Center, if feasible; and
WHEREAS, the Cultural Center of Palm Springs now desires to evaluate the
possible expansion of the existing Convention Center, parking facilities
and a convention hotel on the Adjacent Site, and the development of a cultural
arts center on a nearby site not owned by the City; and
+ WHEREAS the City has determined that it would be in the public interest
" if the Cultural Center of Palm Springs could develop an expansion of the
existing convention center, parking facilities and a convention hotel on
the Adjacent Site; and
WHEREAS, the City approves of such an evaluatiuon of the development and
agrees to amend the aforementioned Memorandum of Understanding to provide
for such study; and
WHEREAS, there is a need to evaluate present facilities expansiuon and there
are a number of legal points that must be evaluated prior to City Council
approval of a development agreement:
NOW, THEREFORE, the City Council of the City of Palm Springs, California,
does hereby resolve as follows:
SECTION 1. Request the Cultural Center of Palm Springs to evaluate the
feasibility of developing an expansion of the existing Convention
Center, parking facilities and a convention hotel on the 5.7-acre
site (the "Site") , which is the subject of a Memorandum of Under-
standing ("Memorandum of Understanding") dated May 21, 1986,
between the Community Redevelopment Agency of the City of Palm
Springs and the Cultural Center of Palm Springs
SECTION 2. Request the Cultural Center of Palm Springs to prepare an
amendment to the Memorandum of Understanding to provide for
the development of an expansion of the existing Convention Center,
parking facilities and a convention hotel on the Site.

SECTION 3. Authorize City Staff to provide a complete review concerning
the fiscal and legal feasibility of the Proposal . -�
SECTION 4. That the Cultural Center of Palm Springs will include in the
Memorandum of Understanding an indication of their intention
to construct a Cultural Center of approximately 2,500-3,000
seats in the second phase of the development on a site within
close proximity to the original site.
