HomeMy WebLinkAbout17046 - RESOLUTIONS - 3/21/1990 RESOLUTION NO. 17046 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, AUTHORIZING CITY MANAGER TO EXECUTE ANY DOCUMENTS NECESSARY TO AMEND THE SUBLEASE BETWEEN O' DONNELL GOLF CLUB AND COMMITTEE OF TWENTY-FIVE, EXTENDING THE SUBLEASE 5 YEARS SO THAT IT WILL EXPIRE JUNE 30, 1997 AND APPROVE EXHIBIT "A", "AGREEMENT AMENDING SUBLEASE", AS TO FORM. WHEREAS the City of Palm Springs is the owner of the property at 421 West Alejo Road; and WHEREAS the premises have been leased to the O'Donnell Golf Club by Lease Agreement No. 826 and approved by City Council by Resolution No. 10298 on April 10, 1972; and WHEREAS the premises have been subleased by O'Donnell Golf Club to the Committee of Twenty-Five by Sublease Agreement No. 826-A and approved by City Council by Minute Order No. 2041 on June 12, 1972; and WHEREAS an amendment to Sublease Agreement No. 826-A was approved by City Council on July 31, 1985 by Resolution No. 15618 to extend the term of the Sublease to June 30, 1992; and WHEREAS the O'Donnell Golf Club and the Committee of Twenty-Five have agreed to amend the Sublease again so that it expires June 30, 1997. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs, California , as follows: Section 1: The City Manager of the City of Palm Springs is hereby authorized to execute any and all documents necessary to approve the Amendment to Sublease between the O'Donnell Golf Club and the Committee of Twenty-Five so that the Sublease is extended to June 30, 1997. Section 2. Exhibit "A" , "Agreement Amending Sublease", is hereby approved as to form. ADOPTED this 21st day of March 1990. AYES: Councilmembers Apfelbaum, Broich, Foster, Neel , and Mayor Bono NOES: None ABSENT: None ATTEST: CITY OF PALM SPRINGS, CALIFORNIA BY -' City Clerk City Manager REVIEWED & APPROVED AGREEMENT AMENDING SUBLEASE THIS AGREEMENT is made this day of 199 by and between Committee of Twenty-five, a corporation, hereinafter referred to as the "Committee" , and O' Donne'll Golf Club, a California corporation, hereinafter referred to as the "Golf Club" , with reference to the following facts : A. On or about May 13, 1972 'the Golf Club, subleased to the Committee the property described as follows: The Committee of Twenty-five Clubhouse Building located at 421 West Alejo Road, Palm Springs , California . The real property included under the provisions of the Sublease include only that real property upon which said clubhouse is situated . Said Sublease hereinafter referred to as "The Sublease" , its due to expire on June 30, 1992. B. The Golf Club and the Committee now desire to amend said sublease in the manner set forth herein. NOW, THEREFORE, it is hereby agreed that the Sublease is amended as follows: The term of the Sublease is hereby extended so that the Sublease will not terminate until June 30, 1997, unless sooner terminated, pursuant to any other provisions of said Sublease. In all other respects the Sublease shall remain valid and binding and in full force and effect as originally written. IN WITNESS WHEREOF, the parties hereto have caused their respective corporate ' names and seals to be hereunto affixed by their duly authorized officers, the clay and year first above written.
