HomeMy WebLinkAbout12/22/1987 - MINUTES CITY OF PALM SPRINGS CITY COUNCIL MINUTES DECEMBER 22, 1987 An Adjourned Regular Meeting of the City ,Council of the City of Palm Springs, California, was called to order by Mayor Bogert, in the Council Chamber, 3200 Tahquitz-McCallum Way, on Tuesday, December 22, 1987, at 3 p.m. ROLL CALL: Present: Councilmembers Apfelbaum, Birer, Foster, Smith and Mayor Bogert Absent: None REPORT OF POSTING OF AGENDA: Report of City Clerk: Agenda posted in accordance with Council policy on December 18, 1987. PUBLIC COMMENTS: None LEGISLATIVE ACTION: 1. MUNICIPAL GOLF COURSE - CLUB HOUSE REMODELLING Recommendation: That the Council approve Change Order No. I (Final ) to increase contract with J.M. Builders, by $33,684. 18, for Municipal Golf Course Club House remodel- ling and improvements, final total amount $183,661. Director of Community Development not available for present- ation; no action was taken. 2. CITY MANAGER EMPLOYMENT AGREEMENT - AMENDMENT Consideration of amendment to employment agreement with City Manager. Councilmember Apfelbaum stated that she would oppose the proposed resolution, and that her decision has nothing to do with the skills or leadership of the City Manager; that her vote is a reminder that leaders need to be leaders; that the voters are being asked to make sacrifices, and leaders will have to think about making those first; that the City Manager is at the top of the City's leadership, along with the City Council ; that the City is on the edge of financial solvency, and must balance its budget, and if the voters are expected to make decisions, it must be shown that spending reductions will have to be made in some way; that a No vote is a symbol of that reduction, from the top to the bottom. Councilmember Birer stated that he would like the City Manager's review to occur in June along with all salary considerations. City Attorney stated that the agreement can be amended to restrict it to six months. Councilmember Smith stated that he agreed the evaluation and salary review should be accomplished in June. CITY MANAGER EMPLOYMENT AGREEMENT (Continued) Councilmember Foster stated that he appreciated Council- member Apfelbaum' s position, but the Council has completed negotiations with the general , fire and police units, and each received a 5% increase, and it is not fair to the last person to be considered to say that the line is going to be held, in order to show the public that the Council is sincere; that the amount is only $2,500, and the City Manager passed up a salary increase two years ago. Councilmember Birer stated that he agreed, and also thinks it is a question of fairness. Councilmember Apfelbaum stated that someone must be first, and someone must be last; and her decision has nothing to do with the Manager' s performance. Resolution 16368, approving amendment to employment agree- ment, was presented; after which, it was moved by Smith, seconded by Birer, and carried by the following vote, that Resolution 16368 be adopted; subject to review in June: AYES: Birer, Foster, Smith and Bogert NO: Apfelbaum ABSENT: None CONSENT AGENDA: 3. MO 4104A awarding purchase of custom credenza for the Conven- tion Center Lobby area to Du Rovan, Inc. , for $6,105.60. (139) 4. MO - - awarding contract for installation of bikeway signs at various bike routes and loop systems, CP 87-42, Agr # 5. MO 4105 awarding purchase of a mini-pickup truck for the Conven- tion Center to Quaid Imports, Inc. , for $7,265.24. (139) It was moved by Smith, seconded by Foster, and unanimously carried, that Minute Orders 4104A and 4105 be adopted; and that Item 4 be continued to December 29, 1987. (Note: subsequent to the meeting, bids on Item 4 were rejected by City Manager pursuant to Purchasing Ordinance) 6. CONVENTION CENTER - INDOOR PLANTS Recommendation: That the Council approve purchase, with one-year maintenance of plants, for the Convention Center, from Plants Plus, not to exceed $14,000; and waive formal bid process. (139) Purchasing Manager reported that three local vendors submit- ted proposals, each with the same plan and cost for the plants; that the maintenance figures ranged from $350 to $750 per month; and that the low proposal , based on ' maintenance, is that of Plants Plus, who also provides service at the Airport Terminal . Minute Order 4106 approving purchase and maintenance as recommended, was presented; after which, it was moved by Birer, seconded by Apfelbaum, and unanimously carried, that Minute Order 4106 be adopted. , v Council Minutes 12-22-87, Page 3 7. USED VEHICLES Upon unanimous approval , the need for action was determined to have arose subsequent to the posting of the agenda. Recommendation: That the Council approve purchase of three used station wagons from Hertz Corporation, only responsive bidder, for $36,338.92; and approve Purchase Order Change Order• No. 1 for a decrease of $2,332; and rescind Minute Order 4062. Purchasing Manager reported that between obtaining the (84) adoption of Minute Order 4062 on November 4, 1987, which authorized the purchase of three station wagons, and con- cluding the purchase, the vehicles were sold. Minute Order 4107 approving purchase and rescinding MO 4062, as recommended, was presented; after which, it was moved by Apfelbaum, seconded by Birer, and unanimously carried, that Minute Order 4107 be adopted. ADJOURNMENT There being no further business, Mayor declared the meeting adjourned to Tuesday, December 29, 1987, at 3 p.m. , in the Large Conference Room, City Hall . /JUDITH SUMICH City Clerk
