OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA, APPROVING CASE 5.0536-PD-210/TTM
24853, A PRELIMINARY PLANNED DEVELOPMENT
DISTRICT AND TENTATIVE TRACT MAP FOR A 260 UNIT
SINGLE-FAMILY RESIDENTIAL SUBDIVISION LOCATED ON
SAN RAFAEL BETWEEN SUNRISE WAY/INDIAN AVENUE, 0-
5 ZONE, SECTION 35.
WHEREAS, the Planning Commission has considered an application by San
Rafael Partnership for a preliminary Planned Development District and
Tentative Track Map for a 260 unit single-family residential subdivision;
and
WHEREAS, the Planning Commission recommends approval with conditions as
outlined in its Resolution No. 4041 ; and
r WHEREAS, the City Council is in agreement; with the recommendation of the
Planning Commission; and
WHEREAS, it has been determined that there are certain requirements as
dictated by ordinance of the Palm Springs City Council and by law of the
State of California; and
' WHEREAS, the requirements are summarized in the staff report dated March
12, 1990.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Palm
Springs , California, does hereby approve the preliminary planned develop-
ment district for property hereinabove described in accordance with the
Following findings and subject to the following conditions .
Findings
1 . That a Planned Development District and Tentative Tract Map are the
appropriate applications for this 260 lot subdivision.
2. That the 3z units per acre are consistent with the General Plan and
Zoning Ordinance.
3. That the site being 76 acres is adequate to accommodate this project.
4. That San Rafael and Avenida Caballeros are adequately designed to
accommodate any traffic generated by this project.
5. That the conditions imposed are necessary to protect the public
health, safety and general welfare of the community.
Conditions
1. That the Development Committee conditions dated February 28, 1990 be
met, a copy of which is on file in the City Clerk's office. .
2. That the final development plans shall be submitted in accordance
with Section 9403.00 of the Zoning Ordinance. Final development
plans shall include site plans , buildings elevations , floor plans,
roof plans, grading plans, landscape plans, irrigation plans ,
exterior lighting plans , sign program, mitigation monitoring program,
site cross sections property development and other such documents
standards as required by the Planning Director. Final development
plans shall be submitted within two (2) years of City Council
approval of the preliminary planned development district.

3. Lots approved for two story structures shall be clearly identified on
the final map for each phase.
4. Second story additions shall not be allowed to any existing single-
story residences .
5. Expansion to approved two-story residences shall require archi-
tectural approval . '
6. As the project is developed, architectural approval shall be required
for each phase.
7. Setbacks shall be indicated on the final map for each phase and
recorded with each deed,
8. Property development standards shall be as follows :
a . Lot area - to be determined by the Planning Commission and City
Council .
b. Lot dimensions - to be determined by the Planning Commission
and City Council .
C. Buildings Height - to be determined at final development stage.
d. Yards
1) Front yards shall have an average setback of 25 ft. the
minimum being 22 ft. and the maximum being 28 ft.
2) Side yards to be determined at final development stage.
3) Rear yards shall have a minimum setback of 15 ft. Those
lots considered through lots shall have a rear ,yard equal
to the font yard required for that lot.
4) Building Coverage shall not exceed 35% of the lot area.
e) All other property development standards shall comply the
appropriate section of the Zoning Ordinance.
9. A maintenance district or a homeowner' s association shall be
established to provide for maintenance of those areas that will be
located outside the walls proposed along Avenida Caballeros , San
Rafael and the second entrance proposed to the subdivision.
10. The codes , covenants and restrictions shall be submitted to the
City for approval .
11. That the filing of the Negative Declaration is ordered .
12. That the school fee be further reviewed at the Council level .
13. That the elevation concept is approved with refinement at the final '
development plan stage.

14. That a meandering combination sidewalk/bikeway 10 feet wide be
provided along San Rafael .
