HomeMy WebLinkAbout11/24/1987 - MINUTES J3 5 CITY OF PALM SPRINM CITY COUNCIL MINUTES NOVEMBER 24, 1987 An Adjourned Regular Meeting of the City Council of the City of Palm Springs, was called to order by Mayor Bogert, in the Large Conference Room, City Hall , 3200 Tahquitz-McCallum Way, on Tuesday, November 24., 1987, at 3 p.m. ROLL CALL: Present: Councilmembers Apfelbaum, Birer, Foster, Smith and Mayor Bogert — Absent: None REPORT OF POSTING OF AGENDA: Report of City Clerk: Agenda posted in accordance with Council policy on November 20, 1987. PUBLIC COMMENTS: None LEGISLATIVE ACTION: 1. AIRPORT TERMINAL - PAINTING Recommendation: That the Council award contract for painting the Airport Terminal to the lowest responsible bidder, George J. Calafat, Painting and Decorating, for $29,244, Agr #2521• Director of Transportation reported that four bids were received for the work; that the low bidder was Xios Construction; that an examination of the references, which included a previous City of Palm Springs project, found that one of three was satisfied with the performance, but it required a lot of supervision; that the second (51 ) of the three references said the contractor was very fast, and everything appears to be satisfactory so far; and the third reference was the General Operations Department for• the Animal Shelter, Library and Stadium; that City files revealed serious problems with the contractor, as described in memoranda, copies of which are on file with the City Clerk, relating to paint not sticking, overspraying cars, and other problems; that he recommended award to the second bidder, including alternate and dropping Surface P/3. Director of General Operations stated contract award to Xios Painting Co. (same License No. as Xios Construction showed in bid document) for work in 1982-83 resulted in major paint peeling, and repainting long before it should have been needed; that workmanship has not been good; and that the low bidder is not recommended. In answer to question by Council , City Attorney stated that warranties are being required on some major projects, excluding State funded projects; that a finding that the quality of work is not what is desired, is one of the few reasons allowed by the State Laws to award a contract to other than the low bidder; that the contractor' s insurance paid for the oversprayed cars in 1983; and that the Council 's options are to findthat Xios is the lowest responsible bidder and award contract to them; to find - that the low bidder is not qualified, and award to the next lowest bidder; or to reject all bids. He stated that the State Law requires that the contractor must be given an opportunity to rebut or present other evidence in his favor. uouncii minutes 11-24-87 Page 2 1. AIRPORT TERMINAL PAINTING (Continued) Rick Burns, Xios Construction, stated that they were not notified so they could take care of the problems; that the memoranda does not indicate how long after the contract was completed that problems occurred; and that they were not asked to come back and fix the problems. It was noted that the memoranda indicates that the painters "came back" after problems were reported. Councilmember Apfelbaum stated that she did not want to award a contract to anyone who has not done quality work, and favored making it part of the records whenever such an occurrence happens; and that warranties should be obtained wherever possible. Minute Order 4083 awarding contract to lowest responsible bidder, George J. Calafat, as recommended, was presented; after which, it was moved by Birer, seconded by Apfelbaum, and unanimously carried, that Minute Order 4083 be adopted. 2. CONVENTION - EQUIPMENT I Bids for the following items were opened prior to the meeting, and materials distributed during the meeting: Purchasing Manager reviewed reports for each, and following questions and answers regarding the nature of the equipment, the following actions were taken. Minute Order 4084 awarding purchase of a forklift, for an amount estimated not to exceed $34,000, from Inland Empire Equipment Inc. , includes approximately $9,000 for (139) options to be negotiated including upgrade to reach 25-foot working height; and Minute Order 4085 awarding purchase of i+mo trash compactors, one wet and one dry, from Mark Costello Company, for $31,615. It was moved by Smith, seconded by Apfelbaum, and unanimously carried, that Minute Orders 4084 and 4085 be adopted. Recommendation concerning scissorlift to be continued to December 2, 1987.
