RESOLUTION NO, 17020 OF THE CITY COUNCIL OF THE CITY OV PALM SPAIL OS, CALIFORNIA, MKING rINDINGS ON PETITION WHEREAS, the CITY COUNCIL of the CETY OF PALM SPRINGS, CALIFORNIA, hes been 4 presented by certain property ownete an Axeouted Petition r"uosting the construc- tion of certain public improvement©, together with eppurt©nnncee and appurtenant work in connection therewith, said improvemente to be constructed pursuant to the terms and proviwigns of the "Runlelpal Improvemunt Act of 1n13" , being Divialon 12 of the Streets and HLghwaye Coda of the eteta of Cmlifornia, in a special assossment dirtrict known and designated as b19TRICT NO. 158 (ANDREAS HILLS) (herein- after referred to ee the "Aseeeoment Diatxiet") ; and, WHEREAS, it has been reported that said Petition container the aignatueeo of more than sixty percent (50%) of the lropwr"zy owner© of the uosooaable area of the property to be subject to a©auzum�tnt for the pr.°opoaed workc of improvement. Said Petition meets the requirements of Stetlon 2804 of Division 4 of the Streets and a Highways Code of tho State of Califoi: aiaa NOVI, THEREFORE, IT IS HEREBY RESOLVED R0 TOLLOWO. SECTION 1. That the above recitals a5e ail true and C®trect. SECTION 2. That it is hereby found that said Petition hays been signed by owners owning fiend constituting more than a1xLy percent QGDec) of all assessable land within the boundaries of the proposed Aaeeenment District, SECTION 3. That said Petition shall be filed with the transcript of these proceed- tngc and ehall remain open to public inspection. SECTION 4. That Said Petition meets the® requiremont€1 of Section 2504 of Divioion 4 of tho Streets and Highways Coda of the State of C9lLf Ornia, and further proceedings and limitations under the provisions o the "Special Aeeenn- ment Investigation, Llmitution and Majority Protost Act of 1911" shall not be applicable to theme prcooeedingn. SECTION 5. This legislative body hereby further finds and determines, based on writLen evidence cubmltted3 that the total estimated amount of the proposed aceessmwnts will not exceed seventy-fivL percent (7511) of the estimated fair market vogue of the land propoocci to be assessed after the proposed public improvements shall have been constructed. SECTION 6. That it in hereby further determined and found that said Petition hae been signed by not only the property owners, xe specified In section 2804 of the Streets and Hlghways Coda, but also any murCgagee or henefl- ciary under any much er.°sting mortgage or deed of trust, as required by Section 2804. 2 of the Streets and Hl.ghwayu code of the State of CallQarnife..
