RESOLUTION NO. 17011
OF THE CITY COUNCIL OF THE CITY OF
PALM SPRINGS, CALIFORNIA, ADOPTING A
RESOLUTION DECLARING SUPPORT FOR
RIVERSIDE COUNTY BOARD OF SUPERVISOR'S 1
RESOLUTION NO. 89-636 RELATING TO
APPOINTMENTS TO THE COUNTY SOLID WASTE
MANAGEMENT ADVISORY COUNCIL.
WHEREAS the State of California has enacted AB 939 which sets in motion
mandatory state-wide source reduction and recycling programs ; and
WHEREAS the legislation mandates the formation of a county-wide task
force to deal with the various elements of AB 939; and
WHEREAS the Riverside County Board of Supervisors has adopted Resolu-
tion No. 89-636 to outline appointments to its task force, The Solid
Waste Management Advisory Council ,
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm
Springs that the said City Council declares its support of the forma-
tion of the Riverside County Solid Waste Management: Advisory Council as
outlined in County Board of Supervisors' Resolution No. 89-6315.
ADOPTED this 7th day of February 1990.

4 ESTABLISHING A SOLID WASTE MANAGEMENT
ADVISORY COUNCIL & RESCINDING RESOLUTION NO. 87-501

6 DE IT RESOLVED AND ORDERED by the Board, of Supervisors of the
7 County of Riverside, State of California, in regular session
8 assembled on December 19 , 1989 , that there is hereby established
9 a Solid Waste Management Advisory Council as follows :
10 1 . Functions
11 a . The Solid Waste Management Advisory Council , herein
12 called Council , shall study, review, evaluate and make
13 recommendations to the Board of Supervisors, herein called Board,
14 relative to the preparation and .future recisions of the County-
15 wide Integrated Waste Management Plan, which shall include
16 source reduction, and recycling elements, and other elements
O17 required by the State to be prepared under the guidance of a new
18 County "Task Force" as set forth in AB 939 ; (Chapter 1095 of the
19 statutes for 1989 ) including any environmental impact reports in
20 connection therewith, coordination with Cities on waste
21 management issues , and solid waste management in general . The
22 Council shall file its reports and recommendations with the Board
-
23 of Supervisors for its consideration and action . The Board may
24 refer back to the Council , as directed by the Board, any proposals
25 and recommendations made by the Council , after action or approval
of the Board .

b. The Council may establish committees as necessary to

gather knowledge and expertise in areas pertaining to Solid Waste
2

Management .

2. Membership.

a. The Council. shall consist of a minimum of
5
members as follows :

( 1 ) SiX persons shall be appointed by the Board

such appointments shall include one member of the

Board (who shall serve as president of the Council ,
9
but shall have no vote) and one person from each

Supervisorial. District .
11
( 2 ) One person who is appointed by the City Council. of
12
each City whose population is certified by that ,
13
Council to exceed 100 , 000 at the time of
14
appointment .
15
( 3 ) Two persons who shall be appointed by the Coachella `
76 galley Association of Governments to represent the
7`7 Cities of Eastern Riverside County not otherw
18 represented on the Council .
19 ( 4 ) Two persons who ;hall be appointed by Western
20 Riverside Association of Governments to represent
21 the Cities of Western Riverside County not
22 otherwise represented on the Council . ,
23 ( 5 ) One member shall be appointed by the Institute of
24 Scrap Recycling Industries .

1 ( 6 ) One member of the environmental community
2 interested in matters of waste management who shall
3 be nominated by the Chairman of the County Board of
4 Supervisors and approved by a majority of the
County Board of Supervisors .

(7 ) Two persons , who are industry representatives ,
6
shill be appointed by the Board of Directors of the
7
County Department of Development . .
8
( B ) Three persons, two who are refuse haulers and one
9
who is a liquid waste hauler , shall be appointed by
10
the San Bernardino and Riverside Counties Disposal
11
Association ,
12
( 9 ) Two persons , who are agricultural representatives ,
13
ti shall be appointed by the Riverside County Farm
14
Bureau, Inc.
y 15 ( 10 ) One person shall be appointed by the Riverside
16 Chapter of the California Council of Civil
17 Engineers and Land Surveyors Association.
18 b. As vacancies occur within the membership
19 appointments allocated hereinabove, appointments shall be made by
20 the concerned appointing authority to fill such vacancies .
21 C. Each appointing authority may appoint an alternate
22 Council Member to serve upon sub-committees or represent their
23 appointing authority during Council meetings in the absence of the
24 primary Council Member .
25 3 . Staff Assistance . The County Administrative Officer ,
26 the County Health Officer , the County Planning Director and the
27 Director of Waste Management or their designated representatives ,

shall each serve as ex offi.c:io members but shall have no vote ,

2 They shall provide such technical assistance an may be required or
3 deemed necessary by the Council . The Director of Waste Management
shall act as secretary of the Council and shall keep its records
4
and transmit its recommendations and reports, and shall prow
5
such staff assistance as may be needed by the Council .
6
Director of Waste Management shall act as administrator of the
7
County Solid Waste Management Flan and , the County-wide
0
Integrated Waste Management Plan and shall be authorized to
9
perform those functions that require, findings of conformance ,
10
County determination of need) and necessity, implementation of goal
11
and policies , and other duties required to meet State and Federal
12
Rules and- Regulations .

4 . Reimbursement. of Expenses . Reimbursement for the voting
14 members ' actual. ,and necessary expenses while carrying out the
15 duties of the Council ::shall be as provided in Section 9 of County f
16
Ordinance Na . 440 ,
17 5 . Vacancies . A vacancy .shall be deemed to exist upon
18 resignation or death of a member , or when a member has faile d
19 attend three consecutive meetIncg and such absence has not been '
20 excused by the Council . A report thereof shall be made by or on
21 behalf of the Council to the concerned appointing authority .
22 6 . Removal of` a Member . Members of the Council shall serve
23 at the pleasure of the concerned appointing authority, and may be
24 removed at any time by such appointing authority .
25 7 . Officers .
26 a . The members of the Council shall elect one of: its
27 members to ,serve as .vise president .

b. The president shall preside at all Council meetings ,

2 exercise general supervision of the affairs and activities of the
Council , and serve as an ex officio member of all Council
3
committees . The chairman shall appoint from Council membership a
o chairperson and committee personnel to serve on each committee
5
established pursuant to this resolution .

C. The vice president shall assume the duties and
7
powers of the president in the event of the president ' s absence .

d . In the event of the president ' s and the vice
9
president ' s absence, the secretary shall supervise the election a
10
president pro tempore .
11
8 . Quorum. A quorum shall consist of eleven members . Any
12
action of the Council shall require affirmative votes of not less
13
t than a quorum, except that less than a quorum may adjourn a
14
meeting sine die or to a specified time and place.

9 . Meetings . The Council shall hold regular meetings at
16
such times and places within the County of Riverside as may be
17
designated by the president or the Council . The calling , giving
1E3 notice and conducting of meetings shall be in accordance with the
19 Ralph M. Brown Act ( Section 54950 et seq . of the Government Code )
20 and as ordered by the president of the Council or as directed by a
21 majority of a quorum,
22 BE IT FURTHER RESOLVED AND ORDERED that Resolution No.
23 87-501 and any and all prior resolutions and orders adopted by
24 this Board relating to the establishment , organization and
' 25 functions of a Solid Waste Management Advisory Council are hereby
26 rescinded.
