OF THE CITY COUNCIL OF THE
CITY OF PALM SPRINGS,
CALIFORNIA, ESTABLISHING:
GUIDELINES FOR SANCTIONING
OF SPECIAL EVENTS WITHIN THE
CITY OF PALM SPRINGS
WHEREAS the City of Palm Springs is committed to sanction
Special Events which contribute to the promotion of tourism,
and;
WHEREAS the City Council finds that in holding special events
the public interest and the benefits derived therefrom
outweigh the temporary inconvenience; and
WHEREAS the City Council finds that special events have an
enormous impact upon the promotion of the community and
contribute to economic revitalization; and
WHEREAS the City Council deems it to be in the best interest
of the citizens of Palm Springs to establish general
guidelines and regulations which govern the sanctioning
process and production of special events.
NOW THEREFORE BE IT RESOLVED that the City Council of the City
of Palm Springs, California, as follows:
Section 1. Definitions
A. it Major special event" means an event
which is produced on a grand scale to
attract thousands of visitors to Palm
Springs for multiple room night stays.
These events receive nationwide and
sometimes international media coverage
as well. as sponsorship from national
corporations. Major special events also
attract nationally and internationally
prominent celebrities. They are
positioned at an off-season or slow period
when the community tourism level needs to
be increased. These special events may
be associated with a national and possibly
local charity. Sanctioning pertains only
to major special events.
B. "Local special activity means an activity
which is produced by local or national
organizers for the local market. These
activities are designed to appeal to the
community but will add to the enjoyment
of the visitor. These activities are
marketed locally but may draw feature
attractions, personalities or acts which
enjoy national acclaim. These special
activities may be associated with a local
charity.

C. "Community impact" includes, but is not
limited to: parking, transportation,
cleanup of the special event area, medical
services, police and services; and other
impacts as identified by the City Manager.
D. "Tourist" is defined as an upscale visitor
with disposable income that; will come to
the community, participate in events and
activities fueling the economy.
Section 2 . Rules anxt Re aulations
A. Organizers of any major special event
shall. apply for a sanctioning not less
than six (6) months and no more than two
(2) years prior to the proposed date of
holding the event.
B. The event is deemed sanctioned when the
City Council so declares by resolution.
The applicant. shall first file the
appropriate sanctioning application. The
application shall be circulated and if
cleared by the respective city departments
and commissions designated by the City ,
Manager for coordination purposes for the
type of event under consideration, a staff
report and a resolution for sanctioning
shall then be developed and presented to
City Council for approval. It shall be
the applicants' responsibility to obtain
building permits, facility use permits,
land use permits and other permits that
are required for the event.
Section 3 . Standards for :Issuance of Sa:nctioninq
A. The event contributes to the promotion of
tourism.
B. The event creates national media
attention, exposure and participation.
C. The event is positioned in a slow
shoulder/off season time period.
D. The event contributes to economic
revitalization.
E. There be a reasonable demand on city
support services which will be determined
by a cost analysis prepared by the City.
F. The event compliments and enhances the
image and direction of the City of Palm
Springs.
G. The event establishes community_.identity.
H. There be a lack of competing similar
events.

I. The event encourages people-, to participate
in the life of the City.
J. The event becomes a tradition in the
community.
K. The event becomes a destination point
' attraction.
L. The event improves community morale and
encourages diverse participation.
M. The event establishes prominent venues for
sponsorship opportunities.
N. The event warrants a multi-dimensional
marketing plan.
0. The event encourages public/private
partnerships.
Section 4 . Contract - When the; City sanctions a special
event, a contract will be negotiated in good
faith with the promoter. It is intent of the
City to produce multi-year events and to enter
into contracts with 3-5 year durations.
Contracts will address items such as the
following,
A. The promoter will be responsible for the
production of the special event.
Responsibilities will be detailed within
the contract along with the City's role
and approval process. The city will
identify key contact staff members for the
various tasks and permits required of the
promoter. When deemed necessary, the City
may require a performance bond or proof
of financial ability to produce the event.
Responsibilities will include but are not
limited to the following:
Development of principals and components
Insurance
Sanitation
Site Map/Plan Development
Concessions/Vendors
Entertainment
Registration
Security and Safety Procedures
Sponsorships
Marketing/Promotions
Permits/Applications

B. The City of Palm Springs will negotiate
whether .it provides such services as
public relations assistance/coordination,
consideration for the suspending of
certain ordinances such as sign, building
and sound, as authorized by Ordinance
#1310. The city will also negotiate the
cost of City support in-kind services
(public: safety', traffic control and
general operations) . In addition to
negotiating support for promoting and
producing special events, the City will
enter into revenue negotiations with the
promoter with respect to, but not limited
to, the following: reimbursement of in-
kind services, finders fee for
sponsorships secured primarily by the 4
City, and. a percentage of product/ticket
sales or broadcast rights. Additionally,
the City will conduct a thorough
evaluation of the participants,
spectators, promoter, sponsors, local
businesses and staff. The City will
reserve: the right to conduct a financial
analysis of the. event.
C. The promoter must indewnify , defend and '
hold the City harmless and provide either
an insurance policy or a •certificate of
insurance including the policy number,
amount,: and the provisions that the City
of Palm Springs is included as an
additional insured. Insurance
requirements shall depend on the risk
level of the event„ and shall be
established and approved by Risk
Management.
Section 5. De_legaic:i.on_- The City Manager may, at his
discretion, delegate any or all of his
functions hereunder, subject to all the
conditions contained herein.
Section 6. Nun-comp LL nce - The event of non-compliance
for safety issues, the special event may be
cancelled if, in the sole opinion of City
Manager or his delegate, the safety issues are
serious enough that they may endanger the lives
of participants and/or spectators. The
assigned "Staff Coordinator" will be the person
responsible for notifying the event organizer
of the safety issues that need to be resolved
and the subsequent cancellation of the event
in the absence of resolution.
