HomeMy WebLinkAbout17006 - RESOLUTIONS - 1/17/1990 i RESOLUTION NO. 17006 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, INIT1'ATTNG PROCEEDINGS, MAKING FINDINGS ON PETITION AND MAKING APPOINTMENTS IN AN ASSESSMENT DISTRICT WHEREAS, the CITY COUNCIL of the CITY OF PALM SPRINGS, CALIFORNIA, has been presented by certain property owners an executed Petition requesting the construction of certain public improvements, together, with appurtenances and appurtenant work in connection therewith, said improvements to be constructed pursuant to the terms and provisions of the "Landscaping and Lighting Act of 1972", being Division 15, Part 2 ` of the Streets and Highways Code of the State of California, in a special assessment district known and designated as "PARKWAYS AND LIGHTING MAINTENANCE DISTRICT NO. 7" (hereinafter referred to as the "Maintenance District") for the following work: To maintain the existing landscaped parkway and storm retention basin along the Satin Rafaell frontage and existing interior street safety lighting of the "Sunrise Norte!" subdivision, Tract 17,642--2. Maintenance costs shall include labor and material costs for upkeep and maintenance and any replacement of the 'irrigation system, lawn, trees, plants and any and all work necessary to keep the green belt area F referenced above in good condition to serve and benefit the boundaries of the Sunrise Norte, Tract 17,642-2. The street safety lights will be maintained by Southern California Edison Co. , who will provide maintenance costs annually. WHEREAS, it has been reported that said Petition contains the signatures of more than sixty percent (60%) of the property owners of the assessable area of the property to be subject: to assessment for the proposed works of improvement. Said Petition meets the requirements of Division 15, Part 2 of the Streets and Highways Code of the State of California; and, WHEREAS, at this time, this legislative body is desirous of making the required appointments and designating persons to perform certain duties, in order to allow the proceedings to go forward to completion in accordance with the provisions of law. NOW., THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS: SECTION 1. That the above recitals are all true and correct. SECTION 2. That it is hereby found that said Petition has been signed by owners owning land constituting more than sixty percent (60%) of all assessable land within the boundaries of the proposed Assessment District. t SECTION 3. That said Petition shall be filed with the transcript of these proceedings and shall remain open to public inspection. SECTION 4. That said Petition meets the requirements of Section 22500 of the Streets and Highways Code of the State of California. SECTION 5. That the place for recordation of the assessment roll and diagram shall be in the Office of the Superintendent of Streets, and said assessment roll and diagram, upon recordation, shall be kept as a permanent record. SECTION 6. That the DESERT SUN is hereby designated as the newspaper for all publications as required by law and as necessary for completion of this Maintenance District. SECTION 7. That the City Contracts Administrator is hereby appointed the the administrator for said proceedings, and said Res. No. 17006 ' l Page 2 Contracts Administrator shall perform all of the duties and responsibilities as set forth by law as they relate to said Maintenance District. SECTION 8. That the City Engineer of the City of Palm Springs is hereby designated engineer for the purpose of these formation proceedings. The City Council hereby directs the engineer to prepare and file with the City Clerk a report in accordance with Article 4 of Chapter 1 of the Landscaping and Lighting Act of 1972. SECTION 9. That the cost of the improvements will be charged to the land which benefits from the improvements, including our land; SECTION 10. That a report will be prepared on the project, including a detailed cost estimate, and a division of the costs among ` the benefited parcels of land, and that the City will conduct a public hearing on the report; SECTION 11. That the cost of engineering, legal and other incidental expenses will be included in the project cost; ' SECTION 12. That the City Council hereby makes the expenses of said maintenance chargeable upon the District hereby declared to be the areas benefited by said maintenance and to be assessed to pay the costs and expenses thereof, said assessments to be collected as part of the property tax assessment by County Tax Collector's Office. SECTION 13. That property with an assessment lien is subject to foreclosure in cases of delinquency and non-payment. I am the duly appointed CONTRACTS ADMINISTRATOR of the CITY OF PALM SPRINGS, CALIFORNIA. That: on the loth day of January, 1990, I reviewed a Petition and Waiver for the formation of an Assessment. District for certain public works of improvement or maintenance of existing facilities and acquisition, where necessary, in a special assessment district known and designated as Parkways and Lighting Maintenance District No. 7 (hereinafter referred to as the "Maintenance District") ,, a copy of which is on file in the office of the City Clerk. That I caused said Petition and Waiver to be examined and my examination revealed that said Petition and Waiver has been signed by property owners representing more than sixty (60%) percent of the assessable area of lands within the boundaries of the proposed Maintenance District, all as prescribed by Section 22500 of the Streets and Highways Code of the State of California ("Landscaping and Lighting Act of 1972"). That said Petition and Waiver did represent Seventy-Seven (77%) percent of the assessable area of property within the boundaries of the Maintenance District. That said Petition and Waiver meets the requirements of Section 22500 of the Streets and Highways Code of the State of California. Executed this 10'th day of January, 1990, at Palm Springs, California.
