HomeMy WebLinkAbout7/1/1987 - MINUTES CITY OF PALM SPRINGS CITY COUNCIL MINUTES JULY 1, 1987 A Regular Meeting of the City Council of the City of Palm Springs, California, was called to order by Mayor Bogert, in the Council Chamber, 3200 Tahquitz-McCallum Way on Wednesday, July 1, 1987, at 7:30 p.m. ROLL CALL: Present: Members Apfelbaum, Birer, Foster, Smith and Mayor Bogert Absent: None REPORT OF POSTING OF AGENDA: Report of City Clerk: Agenda posted in accordance with Council policy on June 26, 1987. COPMIUNITY REDEVELOPMENT AGENCY: Mayor declared the meeting adjourned for the purpose of convening as the Community Redevelopment Agency; after which, members reconvened as the City Council . PRESENTATION OF AWARDS: Mayor presented Employee Recognition Awards to Ron Troy, Parks Division, and, Manny Rodriguez, Police. APPROVAL OF MINUTES: It was moved by Smith, seconded by Foster, and unanimously carried, that the Minutes of June 3, 1987 be approved. PUBLIC HEARINGS: ' 1. STREET LIGHTING MAINTENANCE DISTRICT 3 Recommendation: That the Council overrule protests and confirm annual levy of assessments for maintenance of street lights in the Crossley Tract for 1987-88. Director of Community Development highlighted his report, and stated that no written protests have been received. Mayor declared the hearing opened; there were no appear- ances, and the hearing was closed. Resolution 16240 overruling protests and confirming assess- ments as recommended, was presented; after which, it was moved by Smith, seconded by Foster, and unanimously carried, that Resolution 16240 be adopted. 2. STREET LIGHTING MAINTENANCE DISTRICT 4 Recommendation: That the Council overrule protests and confirm annual levy of assessments for maintenance of street lights on Divot, Par, Eagle & Birdie Way for 1987-88. Director of Community Development highlighted his report, and stated that there were no written protests filed. ' Mayor declared the hearing opened; there were no appear- ances, and the hearing was closed. Resolution 16241 overruling protests and confirming the assessments as recommended, was presented; after which, it was moved by Birer, seconded by Apfelbaum, and unani- mously carried, that Resolution 16241 be adopted. ` 0 Council Minutes 7-1-87 Page 2 3. PARKWAYS MAINTENANCE DISTRICTS 6A, 6B, AND 6C Recommendation: That the Council overrule protests and confirm annual levy of assessments for maintenance of parkways in three areas of the City for 1.987-88. Director of Community Development highlighted his report, and stated that there were no written protests. Mayor declared the hearing opened; there were no appear- ances, and the hearing was closed. Resolution 16242 overruling protests and confirming the assessments as recommended, was presented; after which, it was moved by Birer, seconded by Apfelbaum, and unani- mously carried, that Resolution 1.6242 be adopted. PUBLIC COMMENTS: a) Tuck Broich, President Merchants and Citizens Associa- tion, stated that MACA did not take action to oppose the Wessman project (Welwood Plaza) , but voted against changing the library from its present status. b) Bill Tidd, 2980 E. Tahquitz-McCallum Way, Chairman for the Bicentennial of the Constitution, stated that a commission has been formed, and events planned to commemorate the celebration of the signing of the Constitution on September 1.7; and requested that the Council join with the Cities of Palm Desert and Indio in funding the cost of a fireworks display, estimated to cost $10,000. c) George Goldberg, Palm Springs, commented on what he , considered to be "losses" to the City, including Mary Carlin, Councilmanic districts, Mental Health, Drug & Alcohol Program, Braille Institute;, and swap meets; and projected losses relating to the Auto Center and Water Park. LEGISLATIVE ACTION: 4. MUNICIPAL CODE AMENDMENT - AUCTIONEERS & AUCTION SALES Recommendation : That the Council amend the Municipal Code to retain only those provisions concerning auction sales which do not relate to licensing or regulations pre-empted by State Law; to amend the Code to allow single event auctions wherever public assembly is permitted under a land use permit procedure subject to Planning Commission findings and approval ; and to repeal provisions relating to jewelry auctions. Director of Community Development highlighted his report, which was reviewed in detail at the study session. City Clerk read title of the Ordinance, as follows: AN ORDINANCE OF THE CITY OF PALM SPRRINGS, CALIFORNIA, ' AMENDING CHAPTER 5.04 OF THE PALM SPRINGS MUNICIPAL CODE TO DELETE THOSE PROVISIONS WHICH REQUIRE SPECIAL PERMITS FOR, AND REGULATE THE CONDUCT OF AUCTIONEERS AND AUCTION SALES AND REPEALING CHAPTER 5. 32 OF THE PALM SPRINGS MUNICIPAL CODE RELATING TO JEWELRY AUCTIONS. It was moved by Smith, seconded by Foster, and unanimously carried, that further reading be waived, and that the Ordinance be introduced for first reading. Council Minutes 7-1-87 Page 3 306 5. ZONING TEXT REVISION On May 20, 1987, Council conducted a public hearing on consideration of revisions to the Zoning Ordinance, and related actions, and continued further consideration pending a review of the significant amendments included in it. Planning Director reported that the Council overviewed ' the significant changes at the last study session, and the maximum height in residential zones has been cut back to eighteen feet, in accordance with that discussion; that the recommendation is to adopt the ordinance for 120 days, during which further detailed review will take place. City Clerk read title of the Ordinances, as follows: AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA, INCLUDING INDIAN LAND SITUATED WITHIN THE BOUNDARY OF THE CITY, ESTABLISHING LAND USE CLASSIFICATIONS; DIVIDING THE CITY INTO ZONES; IMPOSING REGULATIONS, PROHIBITIONS AND RESTRICTIONS FOR THE PROMOTION OF HEALTH, SAFETY MORALS, CONVENIENCE, AND WELFARE; GOVERNING THE USE OF LAND FOR RESIDENTIAL AND NON-RESIDENTIAL PURPOSES; REGULATING AND LIMITING THE HEIGHT AND BULK OF BUILDINGS AND OTHER STRUCTURES; LIMITING LOT OCCUPANCY AND THE ( 103) SIZE OF YARDS AND OTHER OPEN SPACES; ESTABLISHING STANDARDS OF PERFORMANCE AND DESIGN; ADOPTING A MAP OF SAID LAND USE ZONES; CREATING BOARDS AND DEFINING THE POWERS AND DUTIES OF SAID BOARDS; PRESCRIBING PROCEDURES FOR CHANGES OF ZONE, CONDITIONAL USE PERMITS, VARIANCES, AND OTHER PERMITS; PRESCRIBING PENALTIES ' FOR VIOLATIONS OF SAID ORDINANCE; AND REPEALING ALL ORDINANCES IN CONFLICT THEREWITH. and AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA, IDENTIFYING THE REGULATIONS FOR THE USE AND DEVELOPMENT OF REAL AND PERSONAL PROPERTY, INCLUDING WATER RIGHTS, SITUATED WITHIN THE EXTERIOR BOUNDARIES OF THE CITY OF PALM SPRINGS WHICH IS LEASED FROM HELD OR USED UNDER AGREEMENT WITH, BELONGING TO OR HELD IN TRUST FOR THE AGUA CALIENTE BAND OF CAHUILLA INDIANS OR ANY MEMBER OF SAID BAND, WHICH ARE SEPARATE AND SPECIFIC FOR SUCH PROPERTY. and AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA, ADDING CHAPTER 11.96 TO THE PALM SPRINGS MUNICIPAL CODE REGULATING THE PARKING AND STORAGE OF VEHICLES IN RESI- DENTIAL ZONES. It was moved by Apfelbaum, seconded by Foster, and unani- mously carried, further readings be waived, and that the ' Ordinances be introduced for first readings. 6. ADDITIONAL LEGISLATIVE ITEMS (Materials at study session) A. Allocated Positions & Compensation Plans for 1987-88, Matter not ready for action, to be rescheduled for July 7, 1987 I 307 Council Minutes 7-1-87 Page 4 CONSENT AGENDA: 7. MO 3957 awarding contract to Hendrickson Construction Inc. to repair and realign two sanitary sewer lines - one in Avenida (128) Caballeros and Baristo, and the other in San Raphael near McCarthy Road; CP 86-28, Agr #2447. 8. MO 3958 approving Amendment No. 1 to agreement with CalTrans ' to increase allowable reimbursement for maintenance of (90) Highway III at a new rate of $21. 30 per sweeping mile, up to $38,000 per year. 9. Res 16243 amending the Comprehensive Fee Schedule to increase sewer facility fees to $2,850 for each residential unit, with (114) corresponding percentage increases for commercial , industrial , and hotel units, effective July 2, 1987. 10. Res 16244 and 16245 approving Payroll Warrants and Claims & (86) Demands. 11. Motion concurring in CRA actions through this date. (124) 12. MO 3959 approving purchase of an Urban Transportation Planning software package from Mohle, Grover and Associates for $7,500. (117) 13. MO 3960 approving proposed revision of the service driveway for the Convention Center (matter previously reviewed in detail (139) at study session of June 23) . 14. Res 16246 approving temporary removal of red curb along Belardo Road for a distance of 300 feet along north side of Fashion (105) Plaza, to create 15 parking spaces until projected traffic , volumes are reached. It was moved by Foster, seconded by Apfelbaum, and unani- mously carried, that Resolutions 16243 through 16246, Minute Orders 3957 through 3960, and motion in Item 11 be adopted. 15. CONVENTION CENTER - CONSTRUCTION CHANGE ORDERS On June 23, 1987 Council continued consideration of Change Orders 7 - 12 to increase contract with McDevitt & Street for construction of the Convention Center. Assistant City Manager recommended that this matter be continued to July 7. (139) It was moved by Foster, seconded by Apfelbaum, and unani- mously carried, that this matter be continued to July 7, 1987. ADDED STARTERS (Determine eligibility for consideration) - None COMMISSION APPOINTMENTS Mayor announced his appointment of Jeanne Mazur to the ' Library Board, for term ending June 30, 1,990, to succeed Rosalyn Bronstein, (60) It was moved by Birer, seconded by Apfelbaum, and unanimously carried, that said appointment be approved.
