AN ORDINANCE OF THE CITY OF PALM SPRINGS,
CALIFORNIA, AMENDING CERTAIN SECTIONS OF THE
PALM SPRINGS MUNICIPAL CODE RELATING TO
ADMINISTRATIVE APPEALS PROCEDURES
' THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DOES
ORDAIN AS FOLLOWS:
SECTION 1. Section 2.05.010 of Chapter 2.05 of Title 2 of the
Palm Springs Municipal Code relating to appeals to the City Council
is hereby amended to read as follows:
2.05.010 Exclusive nrnra_laure. Except in cases involving the
administrative appeals board pursuant to Chapter 2.50 or as
otherwise specifically provided by this code or other ordinances,
all appeals to the city council otherwise allowed by the code or
other ordinances shall be prosecuted in accordance with this
Chapter 2.05.
SECTION 2. Sections 11.72.220 and 11.72.230 of Chapter 11.72 of
Title 11 of the Palm Springs Municipal Code .relating to public
nuisances are hereby amended to read as follows:
11.72.220 Appeal and hearing. The city may conduct a hearing
on, or the responsible party may appeal any determination, order or
other matter relating to the notice of violation as follows:
(1) Administrative Appeals Board. A hearing and/or an appeal
may be made to the administrative appeals board in the manner
' provided by Chapter 2.50 of this code. Absent a contrary
determination rendered by the administrative appeals board, the
responsible party remains obligated to comply with the
determination, order or other matter relating to the notice of
violation and abate the identified violation or nuisance.
(2) Board of Appeals. Where in the discretion of the
director the violation at issue is viewed as technical in nature
such that an evaluation of the existence or extent of the violation
could be performed more expeditiously or effectively by a board of
appeals created pursuant to any adopted uniform building, housing
or safety code, the director may designate such board of appeals as
the appropriate review body relative to the notice of violation.
In this regard, the board of appeals shall follow procedures
substantially similar to those required of the administrative
appeals board pursuant to Chapter 2.50 of this code.
11.72.230 Responsible nart,v to abate. If after an appeal
and/or'hearing pursuant to Section ].1.72.220 the administrative
appeals board or board of appeals concludes that a violation
exists, unless otherwise specified by the administrative appeals
board or board of appeals, said violation shall be abated by the
responsible party forthwith or within the period of time specified
by the administrative appeals board or board of appeals.
' SECTION 3. Wherever used in Section 11.72.250 of Chapter 11.72
of Title 11 of the Palm Springs Municipal Code, the term "city
council" is hereby replaced with the term "administrative appeals
board." Additionally, the number 112.05" contained in the second
sentence of Section 11.72.250 is hereby replaced with the number_
112.50."
SECTION 4. EFFECTIVE DATE. This Ordinance shall be in full 5�l
force and effect thirty (30) days after passage.

SECTION 5. PUBLICATION. 'The City Clerk is hereby ordered and
directed to certify to the passage of this Ordinance, and to cause
the same or a summary thereof or a display advertisement, duly
prepared according to law, to be published in accordance with law.
