HomeMy WebLinkAbout1536 - ORDINANCES - 9/4/1996 ORDINANCE NO. 1536 AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA, AMENDING SECTIONS 9217-1. 03C. AND 9309 . 00 OF' THE ZONING ORDINANCE IN REGARD TO INCREASING THE ALLOWABLE BUILDING HEIGHT IN THE "M-2" ZONE AND DELETING REQUIREMENTS FOR ' RIGHT-OF-WAY DEDICATION FOR RESIDENTIAL PROJECTS WHICH DO NOT CREATE AN INCREASE IN INTENSITY OF LAND USE. THE. CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Section 9217-1. 03C. of the Zoning Ordinance is amended to read as follows: "BUILDING HEIGHT 1. Buildings and structures shall have a height not greater than thirty (30) feet. 2 . Exceptions: a. Permitted Projections Above Building Height Limit: The provisions of Section 9303 . 00 shall apply. b. Buildings and structures may have a height not greater than forty (40) feet, provided 1) that they are located on a parcel of not less than one (1) ' acre in size; and 2) that any portion of the building .in excess of thirty (30) feet is set back 1t feet from any property line along a street for every one (1) foot of vertical rise. " SECTION 2 . Section 9309 . 00D. of the Zoning Ordinance is amended to read as follows: "DEDICATION OF STREETS 1. The applicant for a building permit in any zone district shall dedicate street right-of-way as follows: a. To provide for a half-street in accordance with the ultimate right-of-way shown by the City's General, Plan Street Plan. b. To provide for a minimum half-street of twenty-five (25) feet for any street not shown on the City's General Plan Street Plan. (This requirement may be modified by the Planning Commission for hillside streets or for streets within developed neighborhoods. ) C. To provide for right-of-way as required by a Planned Development District Plan or Specific Plan. 2 . Street dedication shall not be required as follows: ' a. When a building permit is issued for the purpose of remodeling, and said remodeling does not involve extensive construction of the front of '-.Ihe building where it would be possible to conform to required setbacks. b. When a building permit is issued ;:or an addition to a commercial., industrial or multi-family residential yr ,perty which does not increase the 01536 Page 2 #F floor area of an existing structure by more than ten (10) percent and said addition, in the opinion of the Director of Planning & Building, does not increase the intensity of use of the property involved. C. When a building permit is issued for an addition to a single-family residential property which does not ' increase the floor area of an existing structure by more than forty (40) percent. d. When a building permit is issued for the purpose of the demolition of a structure. e. When a building permit is issued for the construction of a wall, as long as said wall is not to be constructed within an existing right-of-way or any future right-of-way as indicated by the General Plan Street Plan. " SECTION 3 . EFFECTIVE DATE. The Ordinance shall be in full force and effect thirty days after passage. SECTION 4. PUBLICATION. The City Clerk is hereby ordered and directed to certify the passage of this Ordinance, and cause the same or a summary thereof or a display advertisement, duly prepared according to law, to be published in accordance with law.
