HomeMy WebLinkAbout1533 - ORDINANCES - 6/19/1996 ORDINANCE NO. 1533 AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA, REPEALING CHAPTER 2.23 OF THE PALM SPRINGS MUNICIPAL CODE AND ADDING A NEW CHAPTER 2.23 THERETO CONCERNING THE ' VISITORS AND PROMOTION COMMISSION. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1 . Chapter 2.23 of the Palm Springs Municipal Code is hereby repealed. SECTION 2. A new Chapter 2.23 is hereby added to the Palm Springs Municipal Code as follows: Chapter 2.23 VISITORS AND PROMOTION COMMISSION Sections: 2.2.3.010 Purpose. 2.23.020 Definitions. 2.23.030 Visitors; and promotion commission -- Creation. 2.23.040 Term--Vacancies. ' 2.23.050 Eligibility. 2.23.060 Failure to fired eligible appointee. 2.23.070 Quorum. 2.23.080 Powers and duties. 2.23.010 Purpose. The City of Palm Springs is an internationally known resort whose most significant economic activity relates to tourism. The commission is intended to represent the various components of the hospitality industry, including hotels, restaurants and retail, along with those sections of the community affected by tourism, including real estate and the residents of the City. The commission is a forum for review and study of tourism issues and for coordinating and facilitating city council decisions and actions concerning tourism. 2.23.020 Definitions. For the purpose of this chapter, "commission" shall mean the Palm Springs visitors and promotion commission. 2 23.030 Visitors and promotion commission -- Creation. There is created within the city a visitors and promotion commission, consisting of eleven members, appointed by the mayor with the approval of the city council, to serve at the pleasure of the city council. ' 2.23.040 Term--Vacancies. Members of the commission shall be appointed or removed in accordance with and shall be subject to all the provisions of Chapter 2.06 of the Palm Springs Municipal Code, as said Chapter now reads, or as it may hereafter be amended from time to time. 2.23.050 Qualifications. p a) Members of the commission shall be eligible for appointment to represent those interests related to tourism specified below, and shall represent such interests. If they no longer represent such interests, they shall become ineligible to serve and their seat shall become vacant. b) The categories of representation shall be as follows: Ord 1533 Page 2 One (1) member shall be an owner or employee manager or employee director of sales from hotels with 1 to 25 rooms; One (1 ) member shall be an owner or employee manager or employee ' director of sales from hotels with 26 to 50 rooms; One (1) member shall be an owner or employee manager or employee director of sales from hotels with 51 to 99 rooms; One (1) member shall be an owner or employee manager or employee director of sales from hotels with 100 to 149 rooms; One (1) member shall be an owner or employee manager or employee director of sales from hotels with 150 or more rooms; One (1) member shall be an owner, manager or employee of a restaurant business; One (1) member shall be a retail merchant owning or managing a store in Palm Springs which possesses a resale permit from the State Board of Equalization for the sale of goods and merchandise; Three (3) members shall be citizens at large, and One (1 ) member shall be employed in and represent the real estate industry with a real estate license. 2.23.060 Failure to find eligible appointee. 8) yf after receipt of the applications there is no eligible applicant for one or more of the categories in Section 2.23.50, then the City Clerk shall issue a second call to attempt to solicit an eligible applicant. As a part of the second call, the City Clerk shall also solicit applicants to serve a one-year interim term if r1s eligible applicant is found. Wr I) the second call does not produce an eligible applicant, the City Council may make an interim appointment to serve a one-year portion of the term of office of the unfilled category. The interim appointee does not need to meet the qualifications of the vacant category but shall meet the qualifications of one otW dategory on the commission. c) Upon the expiration of the term of the interim appointee, the City Council sha�f repeat the regular process to attempt to select an eligible applicant to complete the unexpired term of the category. If no eligible applicant is found, another interim appointment may be made and the interim appointee may be reappointed successively subject to the limitations of Section 2.23.050. 2.23.070 Quorum. A vacancy on the commission shall not impair the right of the remaining members to exercise the powers of the commission pursuant to this Chapter. Six (6) members shall constitute a quorum of the commission, and any ruling, decision or other action of the commission may be taken by a majority of those members present, provided a quorum is present. 2.23.080 Powers and duties. Within the limitations provided by law, the visitors and promotion commission shall have the following powers and duties: (1) To establish a schedule of regular meeting times; (2) To advise on the promotion, advertising, publicity and marketing activities of the city; (3) To serve as a liaison between the hospitality industry/valleywide CVB and the Palm Springs-only efforts; (4) To evaluate the success of marketing efforts; (5) To make recommendations on annual budgets for visitor promotion, expenditure of funds and related issues. SECTION 3. EFFECTIVE DATE. This Ordinance shall be in full force and effect thirty (30) days after passage. Ord 1533 Page 3 SECTION 4. PUBLICATION. The City Clerk is hereby ordered and directed to certify to the passage of this Ordinance, and to cause the same or a summary thereof of a display advertisement, duly prepared according to law, to be ' published in accordance with law.
