CITY OF PALM SPRINGS
CITY COUNCIL MINUTES
AUGUST 3, 1983
A Regular Meeting of the City Council was called to order by Mayor Bogert
in the Council Chamber, 3200 Tahquitz-McCallum Way, on Wednesday, August
3, 1983, at 7:30 p.m.
ROLL CALL: Present: Councilmembers Doyle, Foster, Maryanov, Ortner
.' and Mayor Bogert
Absent: None
The meeting was opened with the salute to the Flag and a moment of
silence.
PRESENTATION:
Mayor presented Reporting Achievement Award to Paul Ron Howard,
Finance Director, from the Municipal Finance Officers Association.
COMMUNITY REDEVELOPMENT AGENCY: Mayor declared the meeting adjourned
for the purpose of convening as the Community Redevelopment Agency;
after which, members reconvened as the City Council .
APPROVAL OF MINUTES:
It was moved by Foster, seconded by Doyle, and unanimously
carried, that the minutes of July 19 and 20, 1983 be approved.
PUBLIC HEARINGS:
1 . PUBLIC NUISANCE ABATEMENT APPEAL - MULLENS
' Director of Community Development reported that representative
of the property owner has contacted the Fire Department (57)
and arranged to have the property cleared to the satisfaction
of the Fire Marshal , and will submit formal withdrawal of appeal .
PUBLIC COMMENTS:
a) Bill Plank, 3155 E. Ramon #201 , stated that a hazard is
created for bicycle riders and pedestrians using the
bikepath along Sunny Dunes, between E1 Cielo and Sunrise
Way, in that poles erected to prevent vehicles from using
the path are not very visible. He suggested the poles
be painted with a fluorescent color.
Mayor requested City Manager to follow-through.
b) Tour Buses:
Dick Crane, Avis-Grayline, stated that there has never been
an accident or problem of any kind in traveling over the
roads proposed to be restricted to buses; that there are
times when large conventions (300+ people) want tours, and (103)
it might be a nuisance to residents to have many vans, with
a few passengers, traveling up and down the street than
a few buses carrying more passengers; that perhaps a special
permit could be granted for special groups, or local
operators.
Ken Adams, 240 E1 Portal , Imperial Tours, stated that he
echoed Mr. Crane' s comments but, did not agree on a special
permit, which he felt would establish a bad precedent. He
stated the area contains 1/2 mile up one side, with 10 houses
and 18 turnouts, and 3/4 mile down the other side, with
20 houses and 26 turnouts, and that there has never been
an accident involving tour buses; that tour buses have not
torn-up the road; that perhaps demand for the street would
necessitate City improving it to full width; that many cities

have scenic routes, and perhaps this could be a one-way
loop; and that the CVB has encouraged them to increase the CONT' D
number of in-bound buses to Palm Springs. (103)
Gene Davidson, Roadrunner Tours, stated that he agreed with
Mr. Crane, and although he did not have the large buses,
he did not believe it would be equitable to prohibit them;
and that hundreds of seniors come to Palm Springs specifically
to see the homes of celebrities.
LEGISLATIVE ACTION:
2. ZTA 5.0262 (CONDITIONAL USE PERMITS)
Director of Community Development reported that revised
recommendation of the Planning Commission, pursuant to directive
of Council , was reviewed in detail at the last study session;
that further questions have come up relative to the type of
commercial use which is normally associated with service stations,
i .e. , a station is proposing to sell commercial food products; (103)
and that this area needs to be clarified, and he recommended
deferring action at this time.
It was moved by Doyle, seconded by Foster, and unanimously
carried, that this matter be continued to the next: meeting pending
clarification of the ordinance as recommended.
3. SECTION 27 OPEN SPACE - PICNIC AREA
Recommendation: That the Council approve proposed improvements '
by Desert Riders, Inc. , to 3-acre City-owned parcel in Section
27, and dedicate the area in honor of Art Smith. Report reviewed
by Director of Community Development, noting that improvement (109) ,
includes picnic tables and hitching area for horses.
Minute Order 3266, approving the picnic area use and improvement
and honoring Art Smith, as recommended, was presented; after
which, it was moved by Doyle, seconded by Maryanov, and
unanimously carried, that Minute Order 3266 be adopted.
4. COMMERCIAL VEHICLE PROHIBITION ON CERTAIN STREETS
Director of Community Development reported that the staff
originally recommended prohibiting the use by commercial vehicles,
except taxicabs, of portion of specific streets, generally (103)
referred to as the Little Tuscany area; however, subsequent
to the last study session, in attempting to address concerns
of the residents and provide equity to the tour operators, the
proposed ordinance was revised to prohibit the use of such streets
by vehicles in excess of 10,000 lbs. He stated that tours could
be conducted via smaller vehicles.
In answer to question by Council , he stated that widening the
streets would alter the character of the neighborhood, which '
he did not believe was desired by the residents in that area;
that from a practical standpoint, the buses make a 1-way loop
of the street, but local residents are not limited to that
restriction; and that it was his understanding the tour activity
has increased over the last year.

City Attorney stated that the differences between vehicle types
are spelled out in the Vehicle Code and Administrative Code,
10,000 lbs. is one criteria, number of passengers, and length
and axle may be factors as well . CONT'D

Councilman Foster stated that a one-way loop would be unfair
to residents.
Councilwoman Ortner stated that by using the roads as a loop,
the widening is not necessary for the buses, and she did not
favor anything that would discourage tourism.
Councilman Doyle stated that he believed the proposal is a
reasonable compromise for resident and tourist concerns; and
that people who live there are entitled to a certain degree
of consideration on the part of the Council regarding privacy,
however, a celebrity pays a certain price for his public status.
City Clerk read title of the Ordinance, as revised, as follows:
AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA, ADDING
SECTION 12.56.042 TO THE PALM SPRINGS MUNICIPAL CODE RELATING
TO ESTABLISHMENT OF CERTAIN COMMERCIAL VEHICLE RESTRICTIONS.
It was moved by Doyle, seconded by Foster, and unanimously
carried, that further reading be waived; after which, it was
moved by Doyle, seconded by Foster, and carried by the following
' vote, that the Ordinance be introduced for first reading:
AYES: Doyle, Foster, Maryanov & Bogert
NO: Ortner

5. SPECIAL MUNICIPAL ELECTION - SPECIAL TAX/POLICE
Recommendation: That the Council adopt Ordinance 1188, as
introduced July 27, 1983; and other actions necessary to call
election, to be consolidated with November 8, 1983, General
Election, and order other matters as required.

AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA, LEVYING
A SPECIAL TAX FOR POLICE PROTECTION, AUTHORIZING SURCHARGE
THEREOF ON RENT-CONTROLLED PROPERTY, AND INCREASING THE CITY
OF PALM SPRINGS' SPENDING LIMIT SET IN ACCORDANCE WITH ARTICLE
XIII B OF THE CALIFORNIA CONSTITUTION BY THE AMOUNT OF THE
PROCEEDS OF THE SPECIAL TAX.
c Resolution 14680, calling the election and providing other matters
required in connection with the election; Minute Order 3267,
authorizing City Clerk to transmit copy of the Ordinance to
' the City Attorney to prepare impartial analysis; and Resolution
14681 , authorizing an argument in favor of the measure to be
filed by the "Palm Springs City Council ," with all members to
attach signature thereto, were presented; after which, it was
moved by Doyle, seconded by Maryanov, and unanimously carried,
that further reading be waived; and Ordinance 1188, Minute Order
3267, and Resolutions 14680 and 14681 , as presented, be adopted.

CONSENT AGENDA:
6. Minute Order 3268 awarding purchase of magnetic tape unit, to transfer
current computer file and software information from IBM to Univac (117)
system, from C & B Software, in amount of $8,215.
7. Minute Order 3269 waiving bidding procedure and authorizing purchase
of repair parts for Ecolotec Vac-U-Sweep to Motor Truck & Equipment (115)
Co. , in amount of $9,085.26 - sole supplier.
8. Resolutions 14682, 14683, 14684 and 14685 approving Payroll Warrants (86)
and Claims & Demands.
9. Resolution 14686 amending the 83-84 budget to appropriate $4,240
to purchase pool safety equipment and supplies. (61 )
10. Minute Order 3270 approving Property Rehabilitation Loan Agreement
with Bank of America for administration of the Sewer Hook-up (85)
Assistance Program.
It was moved by Foster, seconded by Maryanov, and unanimously
carried, that Resolutions 14682 through 14686 and Minute Orders
3268 through 3270 be adopted.

a) CVB - 3rd Quarter 1982-83.
12. COMMISSION APPOINTMENTS:
Mayor announced his appointments to Energy Commission and Library '
Board, after which it was moved by Bogert, seconded by Doyle, (60)
and unanimously carried, that the appointment of Patricia Wilson
and Lynn Krall to the Library Board for terms ending 6-30-86
be approved; and it was moved by Bogert, seconded by Maryanov,
and unanimously carried, that the appointment of Sam Rosenthal
to the Energy Commission to fill existing vacancy (Koopman)
for term ending 6-30-86 be approved.

14. PUBLIC reports or requests
a) Ed Reinwand, 502 S. Calle Santa Rosa, #2„ presented the
Mayor a flag design which he is offering, without obligation,
depicting mountains, the airport fountain, palm trees, and
big horn sheep.
City Attorney noted that the City has not solicited designs
and no remuneration is offered. ,
