HomeMy WebLinkAbout1512 - ORDINANCES - 6/21/1995 ORDINANCE NO. 1512 AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA, AMENDING SECTIONS 2.06.010, 2.06.020, AND 2.06.030 OF CHAPTER 2.06, SECTION 8.05.050 OF CHAPTER 8.05, AND REPEALING SECTION 8.05.060 OF THE PALM SPRINGS MUNICIPAL CODE CONCERNING APPOINTMENTS TO CITY BOARDS & COMMISSIONS. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DOES ORDAIN AS FOLLOWS:. SECTION 1. Section 2.06.010 of Chapter 2.06 of the Palm Springs Municipal Code is hereby amended to read as follow: 2.06.010 General_rules re aiding_appointments, terms. vacancies. (a) Unless otherwise provided by law, or by ordinance adopted after the effective date hereof, all members of boards and commissions of the city shall be appointed for three-year terms commencing on July 1 of the year of appointment; provided, that interim vacancies shall be filled by appointment for the unexpired term of the member replaced. b) Subject to its unfettered legislative discretion, the Council will attempt to ensure that members appointed to city boards and commissions shall reflect the social, ethnic and cultural diversity of the community. c) Persons appointed to a board or commission may be reappointed for up to one additional full term, not to exceed a total of six years of service on such board or commission; such reappointments shall not be construed as automatic, and applicants must go through the same process for reappointment as all other applicants who are seeking initial appointment. d) Except in cases where the Mayor or the City Council are not the appointing authority, no person appointed to a board or commission shall become eligible for appointment to any board or commission for a period of one year from the expiration of his or her service upon any board or commission; provided that any person appointed to an interim vacancy of eighteen months or less, shall be eligible for reappointment to one consecutive full term upon the same board or commission to which the interim appointment was made. After the expiration of one year during which the person has not served upon any board or commission, that person, if otherwise qualified, shall again become eligible for appointment to any board or commission, including without limitation, the board or commission upon which he or she formerly served, subject to the provisions of subsection (c). e) Unless otherwise provided by law, or by ordinance or resolution of the city council, all members of boards and commissions of the city shall be initially, and during their incumbencies, bona fide residents and registered voters of the city, and no such member at or during such 'Lime shall be an employee of the city, nor a current applicant for city employment. f) Any member may be removed front office at any time, with or without cause, by a majority vote, of the members of the City Council, except in cases where the Mayor or City Council are not the appointing authority, in which cases such regular appointing authority may by a majority vote of the members of the appointing authority remove appointees, with or without cause. If a member absents himself without advance permission of the board or commission or of his appointing authority, from three consecutive regular meetings or from twenty-five percent of the duly scheduled meetings of the board or commission within any fiscal year, the chair of the board or commission shall file a certification with the City Clerk that such absences have occurred, and his or her office shall thereupon automatically become vacant and shall be filled as any other vacancy. g) All existing members of any board or commission shall be eligible upon the expiration of their existing term for one additional three year term, unless they have also served an additional interim term, in which case they shall not be eligible for an additional term if their total continuous service would then be more than seven years, counting the additional three year term to which they would be reappointed. /O 6 Ord. No. 1512 r � Page 2 SECTION 2. Section 2.16.020 and 2.16.030 of Chapter 2.16 of the Palm Springs Municipal Code are hereby amended to read as ;follow: 2216.020 MIembersUy--Creatiota. There is created in the city a Regional Airport Commission, ' which shall consist of fifteen mcmbers. The fifteen members shall be appointed in the following manner: eight regular members, appointed by the mayor of Palm Springs in accordance with Section 2.04kO60 of the Palm Springs Municipal Code; five regular members, one appointed by each of the cities of Palm Desert, Cathedral City, indivz 'vVe➢ls, Rancho Mirage, La Quinta, in the manner which each city shall determine; a regular member appointed by the Board of Supervisors, Riverside County; and a rotational member appointed in turn by the cities of Indio, Desert Hot Springs and Coachella in the manner which each city shall determine. The determination of perma.nent and rotational members is based on consideration of population, hotel rooms, hotel sales and distribution of trips to the airport and may be adjusted front Lime to time by amendinent of this section as circumstances warrant. The Palm Springs appointees serving on the Palm Springs airport commission as of the adoption of the ordinance codified in this chapter shall serve out their appointments on the commission created by the ordinance codified in this chap'a°r. The other governnieatal agencies participating in the Regional Airport Commission shall adopt such crrlin.ices, rtdes and regulations as may be necessary to implement the membership provisions hereof. 2.16_030 Men-ibershi --Terms. The term of office for regular members shall be as provided in Code Section 2.04.060 of the Palm Springs Municipal Code for all appointees, except that in order to ensure a stagger of appointees the initial appointments shall be as follows: Number of Appointees Expiration Date Palm Springs 3 6/30/98 Faun Springs 2 6/30/95 Palm Spriorgs 3 6/30/96 Riverside County 1 6/30/95 Rancho Mirage 1 6/30/96 Indian Wells i 6/30/97 Patin Desert 1 6/30/97 Cathedral City 1 6/30/97 La Quint a 1 6/30/97 Rotational 1 Annual The term of office for i oiational members shall be subject to .all thy;provisions of Chapter 2.06 of the. Palm Springs Municipal Code, as the chapter now reads, or as it may thereafter be amended from time to time. Regular nreiriber status shall route each year. Remaining years of said term shall be as an ex offacio member. The order of rotation shall be Indlio, Desert Hot Springs and C.oacheila. Rotation shall occur at the July regular meeting of each year, except that Indio, in its first rotation shall serve from the effective date of the ordinance codified in this chapter until Trine 30, 1995. SBCTICIFI 3. That Section 3.045.050 of the Palm Springs Municipal Code is hereby amended to read, as follows: Ord. No. 1512 Page 3 8.05.050 Term--Vacancies. Members of the board shall be appointed or removed in accordance with and shall be subject to all the provisions of Chapter 2.06 of the Palm Springs Municipal Code, as the chapter now reads, or as it may thereafter be amended from time to time. SECTION 4. That Section 8.05.060 of the Palm Springs Municipal Code is hereby repealed. SECTION 5. Notwithstanding any other section herein, terms commencing on July 1, 1995, on the following boards or commissions shall expire on June 30, 1997; all successive appointments and all other appointments hereunder shall be made in the manner provided in Section 2.06.010: Airport Commission, Planning Commission, Public Arts Commission, Parks & Recreation Commission, and Visitors & Promotion Board. SECTION 6. EFFECTIVE DATE. This Ordinance shall be in full force and effect thirty (30) days after passage. SECTION 7. PUBLICATION. The City Clerk is hereby ordered and directed to certify to the passage of this Ordinance, and to cause the same or a summary thereof or a display advertisement, duly prepared according to law, to be published in accordance with law.
