HomeMy WebLinkAbout1509 - ORDINANCES - 5/3/1995 ORDINANCE NO. 1509 ' AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, AMENDING CHAPTER 3.12 OF TIME MUNICIPAL CODE OF THE CITY OF PALM SPRINGS TO PROMOTE LOCAL BUSINESS ENTERPRISES WHEREAS, the public interest is best served by encouraging businesses to locate, operate, and remain in the City of Palm Springs; WHEREAS, when the City contracts with a local business enterprise for the provision of supplies the City realizes a net return of sales tax which should be accounted for when evaluating the local business enterprise's bid; WHEREAS, local contractors are at a competitive disadvantage in other stales, counties, or cities which give a preference to contractors from the entity in the award of service contracts; WHEREAS, dollars invested in local construction project which include the use of local contractors and sub-contractors results in increased dollars being invested and spent in the City of Palm Springs; and WHEREAS, because of this multiplier effect, the public interest is best served by encouraging contracting and sub-contracting with contractors which are located within the Coachella Valley. ' NOW, THEREFORE, the City Council of the City of Palm Springs hereby ordains as follows: SECTION 1. That Section 112.205 be added to the City of Palm Springs Municipal Code, to read as follows; Section 3.12.205 Local Business Promotion (a) In determining the lowest responsible bidder the the following provisions shall be applied to a bid submitted by a local business enterprise: (1) For any contract for supplies, the net return of any sales tax to the City of Palm Springs to be generated by the purchase of supplies shall be utilized as a bid evaluation factor in determining the lowest net cost to the City. (2) For any contract for services, including construction services, a reciprocal preference shall be given as against a non-local business enterprise contractor from any slate, county or city that gives or requires a preference to contractors from that entity in award of its service contracts. The amount of the reciprocal preference shall be equal to the amount of the preference applied by the entity in with the non-local business enterprise contractor is based as against the bid of a City of Pahn Springs contractor. (b) For all contract bids proposing sub-contractors: (1) the prime contractor shall use good faith efforts to sub-contract the supply of materials and equipment to local business enterprises and to sub-contract services to businesses whose work force resides within the Coachella Valley("local sub-contractor"), ' (2) the prime co.+ntractor shall submit evidence of such good faith efforts at the time of submission of bids. Good faith efforts may be evidenced by placing advertisements inviting proposals in local newspapers, sending requests for proposals to local sub-contractors, or by demodnstrating that io local sub-contractors are qualified to perform the work or supply the materials or equipment. (3) any notice inviting bids which may require the use of sub-contractors shall include notification of this subdivision. (4) the City may reject as non-responsive the bid of any contractor proposing to use sub-contractors that fail to comply with the requirements of this subdivision. Oar, 01509 Page 2 (c) For the purpose of Section, "local business enterprise" shall mean a. busine:;, firm with fixed offices or distribution points within the boundaries of the City of Palm Springs, with a valid busiaess license obtained pursuant to +Chapter 3.44, and a City of Patin Sprhigs business strcet address. Post Office box numbers or residential addresses may not be used solely to establish status as a 'local business enterprise." SECTION 2. EFFECTIVE DATE. This Ordinance shall be in full force and effect thirty (30) ' days after passage. SECTION 3. P"Bk,1CA:PION. The City Clerk is hereby ordered and directed to certify to the passage of this Ordinance, and to cause the same or a summary thereof or a display advertisement, duly prepared according to law, to be published in accordance with law.
