AN ORDINANCE OF THE CITY OF PALM SPRINGS,
CALIFORNIA, AMENDING THE PALM SPRINGS
MUNICIPAL CODE TO ADD CHAPTER 2 . 22 TO
ESTABLISH A VILLAGEFEST BOARD
WHEREAS, in March of 1991, the City commenced a regular Thursday
night street festival on Palm Canyon Drive known as "VillageFest"
to bring entertainment, artisans, crafts, farmers market, and food
vendors to downtown Palm Springs; and
WHEREAS, the VillageFest has been undertaken under the supervision
of staff with an advisory committee operating as the VillageFest
Committee; and
WHEREAS, VillageFest has become an established event, and it is
appropriate to now establish the advisory committee as an on-going
permanent board of the City; and
WHEREAS, it is the purpose of this Ordinance to establish a
VillageFest Board on the same basis as the City's other commissions
and boards.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA, DOES ORDAIN AS FOLLOWS:
SECTION 1. A new Chapter is hereby added to the Palm Springs
Municipal Code, to be numbered 2 . 22 , said chapter to read as

2 . 22 . 010 Created. There is hereby created a
VillageFest Board which shall exist as an advisory body
of the City. It shall consist of five (5) members,
serving without compensation, appointed in the manner
prescribed in Section 2 . 22 . 020 of this Code. All
appointments to the Board shall be for terms also as
prescribed in Section 2 . 22 . 020 of this Code.
2 . 19 . 020 Term--Vacancies--Vote. (a) Members of the
Board shall be appointed or removed in accordance with
' and shall be subject to all the provisions of Chapter
2 . 06 of the Palm Springs Municipal Code, as the chapter
now reads, or as it may be amended from time to time.
Except for the initial staggered terms, members shall
serve for four (4) year terms and until their successors
are appointed and qualified, unless they are earlier
incapacitated, resign, or are removed.

(b) Members of the Board shall have the following
qualifications:
(1) Three (3) members shall be either current
retail merchants or have significant retail experience;
(2) One (1) member shall be a retail merchant
having significant experience in the jewelry business;
and
(3) One (1) member shall represent the
community-wide tourism industry.
2_19 . 030 Officers_-Committees. The Board shall
each year elect from its membership a Chairman and Vice
Chairman. The Chairman and dice Chairman shall have and
perform such duties as are commonly associated with their
respective titles. The Board shall be further authorized
to appoint and fix the membership of such number_ of
standing and temporary committees as it may find
expedient for the performance of its duties. The
Chairmen of said committees shall be members of the
VillageFest Board. The City Manager may appoint a
VillageFest Manager_ and such other staff as may be
necessary to conduct VillageFest. Such staff shall
assist the Board but shall report to the City Manager.
2 . 19. 040 Meetincls -Rules of. Procedure. The Board
shall meet as necessary to review vendor applications in
a timely manner, but: no more frequently than twice per
month, at such time and place as shall be fired by the
Board by its Standing Rules, adopted by resolution. A
majority of the existing appointed members of the Board '
shall constitute a quorum for the transaction of
business. The Board may establish such rules and
regulations as it deems necessary for the conduct of its
business. In matters relating -to preparation of agendas,
the holding of regular and special meetings and the
conduct of such meetings, the Board is bound by the
provisions of. the Ralph M. Brown Act of the State of
California, as amended (Sections 54950, et
California Government Code) .
2 . 19_ 050 Functionss_Powers and Duties. The Board
shall serve in an advisory and administrative capacity to
the City Council as follows:
(a) To review vendor applications and to interview
vendor applicants in regard to their possible future
participation as vendors in VillageFest;
(b) To interpret and apply the VillageFest Rules
and Regulations, as established and approved by City
Council, in the review, interview and selection of
VillageFest vendors;
(c) To vote on the selection of individual_ vendor
applicants for future inclusion as vendors in ,
VillageFest, based upon applicant eligibility as
interpreted from the VillageFest, Rules and Regulations,
and to advise the VillageFest Manager of the 'results of
tote of the Board for each vendor applicant;
(d) To review representative samples, including
selling price, of each item intended to be sold, for

quality, workmanship, appropriateness, and compatibility
with VillageFest goals and purposes;
(e) To determine, after adequate notice and a
hearing, whether to suspend or revoke a VillageFest
participant's VillageFest permit based on violation of
the VillageFest rules and regulations; and
' (f) To advise the City Council on matters relating
to VillageFest, and to assist from time to time in the
review of the administration and operation of
VillageFest.
SECTION 2 . Notwithstanding the provisions of Section 2 . 22 . 010 set
forth above, of the five (5) members first appointed to the Board
at the time this Ordinance takes effect, three (3) shall be
appointed for a term that expires on June 30, 1999, and two (2)
shall be appointed for a term that expires on June 30, 1997 . The
designation of length of term shall. be made at the time of
appointment. Thereafter, all appointments to the Board shall be
for four (4) year terms as prescribed in Sections 2 . 22 . 010 and
2 . 06. 010 of the Palm Springs Municipal Code.
SECTION 3 . EFFECTIVE DATE. This Ordinance shall be full force and
effect thirty (30) days after passage.
SECTION 4 . PUBLICATION. The City Clerk is hereby ordered and
directed to certify to the passage of this Ordinance, and to cause
the same or a summary thereof or a display advertisement, duly
prepared according to law, to be published in accordance with law.
