HomeMy WebLinkAbout9/28/1982 - MINUTES CITY Or PALM SPRINGS CITY COUNCIL MINUTES SEPTEIMBER 28, 1982 An Adjourned Regular Meeting of the City Council was called to order by Mayor Bogert, in the Large Conference Room, City Hall , 3200 Tahquitz-McCallum Way, on Tuesday, September 28, 1982, at 3 p.m. ROLL CALL: Present: Councilmembers Doyle, Foster, Maryanov and Mayor Bogert Absent: Councilmember Ortner LEGISLATIVE ACTION: 1 . VIDEO ELECTRONIC GAMES Recommendation: That the Council adopt interim ordinance prohibiting the installation of video electronic games within the City. City Attorney stated that, at its last meeting, the Planning Commission gave tentative approval to an ordinance which would change regulations regarding video games, in particular, in the downtown (103) area ; that the Government Code provides that the Council may impose a moratorium on any use which would then become non-conforming if in-place prior to new regulations, if desired during the time of consideration of the proposed amendment; and that such an action would require a 4/5 vote of the Council . HERE COUNCILWOMAN ORTNER entered and joined the ' meeting. Director of Community Development reported that the Planning Commission has determined that four games would be an accessory use; that there has been some challenge to the authority of that deter- mination; and that the interim ordinance is proposed in order to preclude installation of games which become non-conforming upon adoption of the ordinance. In answer to question by Council , City Attorney stated that the Council could prohibit installation of video games of more than four in any one location, or prohibit in specific zones, or specific number of games in specific zones; that proposed ordinance would prohibit new installations anywhere in the City; and that uses in operation prior to the adoption of the ordinance might constitute a valid non-conforming use. In answer to question by Council , City Attorney stated that occupancy permit issued to the "Amusing Sandwich" prohibited video electronic games ; and that the ' interim ordinance would remain in effect for four months, or until amended, repealed, or an ordinance covering the subject is adopted. r / L 1 Council Minutes 9-28-82 Page 2 1 . VIDEO GAMES (Continued) City Clerk read title of Ordinance 1165, as follows: AN INTERIM ORDINANCE OF THE CITY OF PALM SPRINGS TO PROHIBIT THE INSTALLATION OF VIDEO ELECTRONIC -I GAMES WITHIN THE CITY. (103) It was moved by Foster, seconded by Maryanov, and unanimously carried, that further reading be waived, and that Ordinance 1165 be adopted. 2. AIRPORT GRANTS - -05, -07, & MULTI-YEAR Recommendation: That the Council accept Amendment #2 to grant agreement for 6-06-0181-07; accept Amendment #5 to grant agreement for 6-06-0181--05; and accept Grant Offer for AIP 3-06-0181-01 , in total amount of $1 ,702,198, as a multi-year grant. Transportation Director reviewed his reports, outlin- (51 ) ing ,scope of the amendments, noting that $136,865 of the project costs for Taxiway X and Y and the fire protection water main extension, under the multi-year grant, is subject to reimbursement by JimsAir, in accordance with the terms of its lease. He stated that JimsAir is committed to that amount, subject to actual construction bids; that it would be subject to payment thereof as progress payments are made to the contractor; and that the water — main - could be used to provide protection, but currently not for domestic water use. Resolutions 14388 through 14390, approving amendments and multi-year grant, as recommended, respectively, were presented; after which, it was moved by Doyle, seconded by Foster, and unanimously carried, that Resolutions 14388 through 14390, inclusive, be adopted.
