HomeMy WebLinkAbout1470 - ORDINANCES - 4/6/1994 ORDINANCE NO. 1470 AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA, AMENDING CHAPTER 2.16 OF THE PALM SPRINGS MUNICIPAL CODE, BY REPLACING THE EXISTING CHAPTER IN ITS ENTIRETY WITH A NEW CHAPTER ESTABLISHING THE PALM SPRINGS REGIONAL AIRPORT COMMISSION WITH VALLEY-WIDE REPRESENTATION. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1 . Chapter 2.16 of the Palm Springs Municipal Code, as of May 20, 1994, is deleted in its entirety and replaced by the following: "CHAPTER 2.16" PALM SPRINGS REGIONAL AIRPORT COMMISSION Sections: 2.16.010 Definitions 2.16.020 Membership - Creation 2.16.030 Membership - Terms 2.16.040 Officers - Committees 2.16.050 Meetings 2.16.060 Powers - Duties 2.16.010 Definitions: For the purpose of this chapter, "Commission" shall mean the Palm Springs Regional Airport Commission. For the: purpose of this chapter, "active members" shall mean the regular members and the one rotational member serving in his or her rotational year. 2.16.020 Membership -Creation: There is created in the City a Regional Airport Commission. Said Commission shall have regular members appointed to four year terms and rotational members appointed to one year terms. Rotational members, when not serving in their rotational year, shall serve as ex officio members. The Regional Airport Commission shall consist of thirteen members; the mayor of Palm Springs, appointing seven regular members, per Section 2.04.O60 of the Palm Springs Municipal Code; a regular member being appointed by each of the cities of Palm Desert, Cathedral City, Indian Wells, Rancho Mirage, in the manner which each city shall determine, and a regular member appointed by the Board of Supervisors, Riverside County, with the rotational member appointed in turn by the cities of La Ouinta, Indio, Desert Hot Springs and Coachella in the manner which each city shall determine. The determination of permanent and rotational members is based on consideration of population, hotel rooms, hotel sales and distribution of trips to the Airport and may be adjusted from time to time as circumstances warrant. The Palm Springs appointees serving on the Palm Springs Airport Commission as of the adoption of this Ordinance shall serve out their appointments on the Commission created by this Ordinance. The other governmental agencies participating in the Regional Airport Commission shall adopt such Ordinances, Rules and Regulations as may be necessary to implement the membership provisions hereof. Ord 1470 Page 2 2.16.030 Membership -Terms: The term of office for regular members shall be four years for all appointees, except that in order to ensure a stagger of appointees the initial appointments shall be as follows: No. of Appointees Expiration Date Palm Springs 3 6/30/94 Palm Springs 2 6/30/95 Palm Springs 2 6/30/96 Riverside County 1 6/30/95 Rancho Mirage 1 6/30/96 Indian Wells 1 6/30/97 Palm Desert 1 6/30/97 Cathedral City 1 6/30/97 Rotational 1 Annual 13 The term of office for rotational members shall be one year with regular member status and three years as an ex officio member. The order of rotation shall be La Quinta, Indio, Desert Hot Springs and Coachella. Rotation shall occur at the July regular meeting of each year, except that La Quinta, in its first rotation shall serve from the effective date of this Ordinance until June 30, 1995. Members of the Commission appointed by the mayor of Palm Springs shall be appointed and removed in accordance with and shall be subject to all the provisions of Chapter 2.06 of this Code. Members of the Commission appointed by other governing agencies shall be appointed and removed under the provisions of said agencies' rules and regulations except if a regular or rotational member, including a rotational member during ex officio years, absents himself or herself without advance permission of the Commission from three consecutive regular meetings or from twenty-five percent of the duly scheduled meetings of the Commission within any fiscal year, the chair of the Commission shall file a certification with said commissioner appointing authority and his or her office shall thereupon automatically become vacant. 2.16.040 - Officers - Committees: Designation of the chairperson and vice chairperson for the Commission shall be governed by Section 2.06.020 of this code, except that from the effective date of this Ordinance through June 30, 1995, the chair and vice chair shall remain as in effect at the time of adoption of this Ordinance. The chairperson shall be a member from the City of Palm Springs. The chairperson shall have the authority to appoint and affix the membership of such number of standing and temporary committees as he or she may find expedient for the performance of its duties. 2.16.050 Meetings - Rules of Procedures: The Commission shall hold one regular meeting, each month, on a date and at an hour to be fixed by resolution of the Commission, and shall hold adjourned regular meetings and special meetings at such times as circumstances shall require. A majority of the existing appointed active members of the Commission shall constitute a quorum for the transaction of business. The Chairman shall be consulted on the preparation of the meeting agenda. The Commission may establish such rules and regulations as it deems necessary for the conduct of its business. The Director of Aviation or his or her designee, shall attend all meetings of the Airport Commission, furnish necessary material, data, maps, and records, submit proposals and recornmendations and provide technical assistance and advice, as required. 2.16.060 Powers - Duties: The Regional Airport Commission shall be advisory to the Palm Springs City Council and shall have the duty and power to advise the City Council on the following matters. 1 . Study and consider long-range plans for ultimate development of Palm Springs Regional Airport, including property acquisition and use, giving due regard to any master plan adopted by the City, and to federal and state regulations; Ord 1470 Page 3 2. Develop valley-wide strategy for implementation of full customs facilities at the Airport; 3. Keep abreast of major operational programs at the Airport; 4. Study and recommend on matters relating to Airport improvements, including methods of financing and leasing arrangements; 5. Review and recommend on special permits and proposals that deviate from the Airport's Master Plan; 6. Keep abreast of developments in the aviation industry, study and recommend types of services to be offered at the Airport; 7. Keep respective elected bodies informed of activities at the Airport and recommend to those same bodies valley wide initiatives to assist the Airport; 8. Review, annually, a summary budget of the operation of the Airport; 9. Review and assist in the development of Airport marketing programs with particular emphasis in the area of air service development; 10. Review and assist in the development of Airport promotional/advertising programs with particular emphasis on getting service area citizenry to fly from Palm Springs; 1 1 . Provide leadership as representatives of various Coachella Valley cities in the development and maintenance of an airport support group; 12. Provide coordination with agencies or committees dealing with Airport issues; 13. Review and recommend on the max of ground transportation access to the Airport, and 14. Participate in valley-wide lobbying efforts, state and federal, to assist the Airport. 15. Perform other advisory duties as directed by City Council with all reports first submitted through the Office of the City Manager. SECTION 2. EFFECTIVE DATE. This Ordinance shall be in full force and effect 30 days following adoption. SECTION 3. OPERATIVE DATE. This Ordinance shall become operative or) May 20, 1994. SECTION 4. PUBLICATION. This City Clerk is hereby ordered and directed to certify to the passage of this Ordinance, and to cause: same or a summary thereof or a display advertisement, duly prepared according to law, to be published in accordance with law.
