AN ORDINANCE OF THE CITY OF PALM SPRINGS
AMENDING SECTION 11.70. 020 OF PALM SPRINGS
MUNICIPAL CODE BY ADDING SECTION 11.70. 020 (D)
REQUIRING RETAILERS DISPLAYING ALL TYPES OF
GRAFFITI IMPLEMENTS TO BE INACCESSIBLE TO
ANYONE NOT AN EMPLOYEE OF THE RETAILER
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA DOES
ORDAIN AS FOLLOWS:
SECTION 1. Section 11. 70. 020 of Chapter 11. 70 to the Palm Springs
Municipal Code is hereby amended by adding subsection (d) to read
as follows:
11. 70. 020 Spray Paint--Sale to Minors.
(d) No person or business engaged in a commercial enterprise
shall display for sale, trade or exchange, any graffiti
implement except in an area from whcih the public shall
be securely precluded without employee assistance. Two
such acceptable methods for displaying graffiti
implements for sale shall be by containment in (1) a
completely enclosed cabinet or other storage device which
shall be permanently affixed to a building or structure,
and which shall, at all times except during access by
authorized representative, remain securely locked; or
(2) in an enclosed area behind a sales or service counter
form which the public is precluded entry. Graffiti
implement means any aerosol paint container; a felt tip
marker with a tip, at its broadest width, is greater than
one eighth (1/8th) of an inch; preprinted gum label;
paint or graffiti stick containing a solid form of paint,
chalk, wax, epoxy, or other similar substance capable of
being applied to a surface by pressure and leaving a mark
at least one-eighth (1/8th) of an inch in width; etching
tool; or any other device capable of scarring or leaving
a visible mark on glass, metal, concrete, or wood or any
other surface.
SECTION 2 . EFFECTIVE DATE. This Ordinance shall be in full force
and effect thirty (30) days after passage.
SECTION 3 . PUBLICATION. The City Clerk is hereby ordered and
directed to certify to the passage of this Ordinance, and to cause
the same or a summary thereof or a display advertisement, duly
prepared according to law, to be published in accordance with law.
