AN ORDINANCE OF THE CITY OF PALM
SPRINGS, CALIFORNIA, AMENDING
SECTION 6.04.070 AND ADDING SECTION
14.16.010(I) AND 14.16.415 TO THE
PALM SPRINGS MUNICIPAL CODE,
ESTABLISHING A POLICY REGARDING
TRASH DUMPSTERS, IN COMMERCIAL
AREAS, ON PUBLIC STREETS
WHEREAS, the City Council of the City of Palm Springs is
desirous of having a uniform policy regarding the placement of
trash dumpsters within its jurisdiction; and
WHEREAS trash dumpsters are a necessity for large construction
projects in order to assist in the cleanliness of the area;
and
WHEREAS a number of areas within the City of Palm Springs do
not have land upon which to place a large trash dumpster on
site during construction or clean-up; and
WHEREAS the City Council of the City of Palm Springs desires
to establish a policy relative to the placement of large trash
dumpsters used during construction or clean-up.
The City Council of the City of Palm Springs, California, does
ordain as follows:
SECTION 1. Section 6.04.070 of the Palm Springs Municipal
Code, Commercial type bins, is hereby amended in total to
read as follows:
6.04.070 Commercial tvue bins-. A commercial type bin
shall be of welded steel construction suitable for the
storage of refuse, and shall be equipped with slots or
other devices capable of being engaged by the arms of a
front loading refuse truck designed for that purpose.
Commercial type bins shall not be placed in or on public
right-of-ways adjacent to commercially zoned property
prior to obtaining an encroachment permit in compliance
with the provisions of Chapter 14.16.
SECTION 2. Section 14.16.010(I) is hereby added to the Palm
Springs Municipal Code reading as follows:
Section 14.16.010(I) Setting, establishing, -erecting or
maintaining any trash container or other structure on or
over or under the right-of-way adjacent to any land zoned
for commercial use.
SECTION 3. Section 14.16.415 is hereby added to the Palm
Springs Municipal Code to read as follows:
Section 14.16.415 Commercial trash bins. An
encroachment permit shall be issued for a commercial type
bin only where the applicant shows that there is no
reasonably accessible and alternate on -site location for
the bin. No bin shall be placed in a traffic lane or
shall be placed so as to obstruct visibility of on -coming
traffic. The bin shall be covered except when in use and
the trash shall not be higher than the lip of the bin.
Bins used in connection with a Special Event shall not be
placed in the public street within one day before or
after, nor during, the Special Event.

SECTION 4. EFFECTIVE DATE:. This Ordinance shall be in full
force and effect thirty (30) days after passed.
SECTION 5. PUBLICATION. The City Clerk is hereby ordered and
directed to certify the passage of this Ordinance, and to
cause same or a summary thereof or a display advertisement,
duly prepared accordincf to law, to be published in accordance
with law.

I HEREBY CERTIFY that the foregoing Ordinance 1456 was duly adopted
by the City Council of the City of Palm Springs, California, in a
meeting held on the 20th day of October, 1993, and that same was duly
published in the DESERT SUN, a newspaper of general circulation on
October 26, 1993.
