AN ORDINANCE OF THE CITY OF PALM SPRINGS,
CALIFORNIA, EXTENDING THE INTERIM ZONING
REGULATIONS OF ORDINANCE 1446 TO RESTRICT THE
INSTALLATION OR USE OF ANY SIGN (INCLUDING
MAIN HOTEL SIGNS AND ATTRACTION BOARDS) FOR
PURPOSES OF DISPLAYING HOTEL RATES, AND
DECLARING THE URGENCY THEREOF.
WHEREAS the Palm Springs Zoning Ordinance, Section 9320. 06,
regulates signs for hotels and permits the use of a main
identification sign and an attraction board. Neither Section
9320. 06 nor any other section of the Palm Springs Zoning Ordinance
regulates the display of rates and other information on such signs;
and
WHEREAS the City Council finds that regulation or prohibition of
signs displaying hotel rates and other information must be
established, including the nature of rate information, the accuracy
and validity thereof, size and type of lettering, color, design and
similar matters.
WHEREAS, on June 2, 1993 , the City Council adopted Urgency
Ordinance 1446 establishing interim regulations prohibiting the use
of hotel rate signs, and now wishes to extend the provisions of
said urgency ordinance.
NOW, THEREFORE, BE IT RESOLVED, THE CITY COUNCIL OF THE CITY OF
PALM SPRINGS, CALIFORNIA, DOES ORDAIN AS FOLLOWS:
SECTION 1. DECLARATION OF FACTS CONSTITUTING URGENCY. The City
Council hereby finds that Ordinance 1446 is required to prevent a
current and immediate threat to the public health, safety and
welfare, in that the approval of hotel rate information on hotel
signs would result in that threat to public health, safety or
welfare. Allowing hotel rate information on hotel signs visible to
the public is not in keeping with the integrity of the community.
It shall cause undue competition and possible hardship among the
hotels within the City and create an unappealing ambiance.
Additionally, the displaying of hotel rate signs will be
inconsistent with the aesthetic quality of other signs within the
City. The City needs to study how rate information should be
presented, the accuracy and validity thereof, the effect on the
economic viability of the business, and the aesthetics of such
presentation, including the size and type of lettering, materials
and color, and overall design to enhance visibility and
attractiveness.
SECTION 2 . DENIAL OF APPLICATION FOR PERMITS FOR SIGNS CONTAINING
HOTEL RATES. The City Council hereby finds that during the time
Ordinance 1446 is in effect, (i) no hotel rate signs shall be
permitted, (ii) no applications for hotel rate signs shall be
accepted for processing or processed, and (iii) no sign permits
shall be issued for any hotel sign which displays or intends to
display hotel rates. For purposes of this Ordinance, a "hotel rate
sign" shall be a display at a hotel or motel meeting the definition
of a "sign" in the Zoning Ordinance upon which any rates for
accommodations at the hotel or motel are included.
SECTION 3 . CONSISTENCY WITH ZONING ORDINANCE. The City Council
hereby finds that Ordinance 1446 is consistent with the Palm
Springs Zoning Ordinance in that it promotes consistency with the
aesthetic quality of other approved signs within the community and
the ambience of the community.

SECTION 4 . EXTENSION OF INTERIM REGULATIONS. '.phis Ordinance is
intended to extend the interim regulations concerning the
prohibition of hotel rate signs as established in ordinance 1446 .
This Ordinance shall take effect immediately upon its adoption by
at least a four-fifths (4/5) 'vote of the City Council and shall
remain in effect for 10 months 15 days from the date of its
adoption. However, the City Council, after notice pursuant to
Government Code Section 65090 and a public hearing may by a 4/5
vote extend this Ordinance for an additional year.
SECTION 5 . URGENCY. The City Council hereby declares this
Ordinance to be an urgency measure in accordance_ with Government
Code Section 65858 .
SECTION 6. SEVERABILITY. It is the intention of the City Council
that the sections, subsections, clauses and phrases of this
ordinance are severable, and if any portion of this Ordinance is
for any reason held to be invalid or unconstitutional by a court of
competent jurisdiction, such decision shall not affect the validity
of the remainder of the Ordinance, and City Council would have
enacted such remainder without the portion found to be invalid or
unconstitutional.
SECTION 7 . PUBLICATION. The City Clerk of the City of Palm Springs
shall certify to the passage and adoption of this Ordinance, and
shall cause the same to be posted and published in the manner
required by law.
