AN ORDINANCE OF THE CITY OF PALM SPRINGS,
CALIFORNIA, AMENDING SECTION 6.04.212 AND
SECTION 6. 04 .215 OF TITLE 6 OF THE PALM
SPRINGS MUNICIPAL CODE RELATING TO REFUSE
DISPOSAL
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES ORDAIN AS
FOLLOWS:
SECTION 1. That Section 6.04 .212 of Chapter 6. 04 of Title 6
of the Palm Springs Municipal Code be, and the same is hereby,
amended to read as follows:
6. 04. 212 Termination of Service. city, or its agent,
when authorized by the City Council, may terminate
service to any business or residential premises with
commercial type bin or other containerized service for
nonpayment when fees and charges for Waste and Recyclable
Material collection services remain unpaid for sixty or
more days. Termination of service for nonpayment shall
cause the owner or occupant to be in violation of Section
6. 04 .200 of this chapter.
SECTION 2 . That Section 6. 04.215 of Chapter 6. 04 of Title 6
of the Palm Springs Municipal Code be, and the same is hereby,
amended to read as follows:
6.04.215 Delinquent Fees and Charges Alternative
Method of Collection. Any fees or charges for Waste and
Recyclable material collection services which remain un-
paid for a period of sixty or more days after the date
upon which they were billed may be collected thereafter
in the manner provided in Government Code Section 25831
and 38790.1. The amount owed may also be subject to a
fee for administration and handling in an amount approved
by Resolution of the City Council. The remedy provided
by this section is cumulative and alternative to any
other method of collection of such delinquent fees and
charges.
SECTION 3 . EFFECTIVE DATE.. This Ordinance: shall be in full
force and effect thirty (30) days after passage.
SECTION 4 . PUBLICATION. The City Clerk is hereby ordered and
directed to certify to the passage of this Ordinance:, and to
cause the same or a summary thereof or a display advertise-
ment, duly prepared according to law, to be: published in ac-
cordance with law.
