HomeMy WebLinkAbout1419 - ORDINANCES - 7/21/1992 ORDINANCE NO. 1419 AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA, ADDING SECTION 3 .24.037 TO THE PALM SPRINGS MUNICIPAL CODE IMPOSING AN ADDITIONAL EIGHT TENTHS OF ONE PERCENT ( .8%) TRANSIENT OCCUPANCY TAX, AND AMENDING CERTAIN OTHER SECTIONS OF CHAPTER 3 .24 OF THE MUNICIPAL CODE, ADOPTED .PURSUANT TO GOVERNMENT CODE SECTION 36937 (d) THE CITY COUNCIL OF THE CITY OP' PALM SPRINGS, CALIFORNI.A, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Section 3.24 . 037 is hereby added to the Palm Springs Municipal Code to read as follows: 3`24.0037 Additional tax imposed -,use of proceeds. in addition to the tax imposed by Section 3 .24.030, Section 3 .24.035, and Section 3 .24.036, for the privilege of occupancy in any Group Meeting Hotel on or after July 1, 1992, each transient is subject to and shall pay an additional tax in the amount of eight 'tenths of one percent ( .8%) of the rent charged by the operator. The additional tax im- posed by this section shall be administered and collected in the same mangier, and :is subject to all of the same definitions, exemptions, rules,, and regulations as the tax imposed by Section 3 . 24.030, except that the -tax imposed by this section shall be paid into the general fund of the City to be used for the usual and current expenses of the City, and the. provisions of Section 3 .24.030 shall not apply to the tax imposed by this section. The tax imposed by this section shall. take effect on August 1, 1992, and shall expire on June 30, 1993, unless extended by specific City Council action. SECTION 2. Section 3.24. 020, definitions, is amended as follows: (9) "Group Meeting hotel" shall :mean a hotel meeting the following cri.eria: A. ) A minimum of 125 rooms, B. ) Meeting space for 125 people, and C. ) Has personnel specifically employed, other than the general manager or director, whose primary job responsibility is group sales. Provided that where a hotel has ]petitioned the Council for a review of its group hotel stratus, the Tax Administrator may modif!r, that status as follows: 1) A hotel not meeting the criteria specified above: may be subject to the tax provided in Section 3.24 .037 if the hotel is found to receive group sales from the tourist group / promotion activities of the City or the �/�. No. 1419 Page 2 d l'I promotional agencies supported by the City, or 2) A hotel ¢which prima facia meets the criteria above as a group hatel may be excluded if the hotel is found not to receive group sales from the tourist group promotion activities of the City or the promotional agencies supported by the City. SECTION 3. Effective Date. This ordinance, being an ordin- ance relating to taxes for the usual and current expenses of the City, shall take effect immed- iately upon its passage, pursuant to Government Code Section 36937 (d) . SECTION 4. Severability. In the event any section, sub- section, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent juris- diction, such portion shall be deemed as a separ- ate, distinct, and independent provision, and such holding shall not affect the validity of the re- maining portions of this Ordinance. SECTION 5. Publication. The city clerk is hereby ordered and directed to certify to the passage of this ordin- ance, and to cause the same or a summary thereof or a display advertisement, duly prepared accord- ing to law, to be published in accordance with the law.
