AN ORDINANCE OF THE CITY OF PALM SPRINGS,
CALIFORNIA, AMENDING CHAPTER 5. 60 OF THE PALM
SPRINGS MUNICIPAL CODE RELATING TO GOING OUT
OF BUSINESS SALES TO ESTABLISH ELIGIBILITY
REQUIREMENTS OF ONE YEAR FOR PERMIT ISSUANCE.
The City Council of the City of Palm Springs, California, does
ordain as follows:
SECTION 1. Chapter 5. 60 of the Palm Springs Municipal Code is
hereby amended by changing the title to read "Business Closing
Sales" and amending Section 5. 60. 020 to read as follows:
5. 60. 020 Eligibility for Permit. No person, firm or corporation
shall be eligible to publish or conduct any sale as described in
Section 5. 60. 010, without first having obtained a permit from the
City Manager in the manner hereinafter provided in this chapter,
but such person shall not be eligible for a permit for a period of
at least 365 consecutive calendar days from the opening of the
business unless good cause is shown therefore to the City Manager.
SECTION 2 . EFFECTIVE DATE. This Ordinance shall be in full
force and effect on March 4, 1992 upon the its adoption by the City
Council. This Ordinance is adopted as an Urgency Ordinance for the
immediate preservation of the public peace, health, and safety
based upon the following facts:
(1) The image of the City of Palm Springs as a vital and active
community where business, residential, tourist and other activities
thrive is essential to the public health, safety and welfare.
(2) The indiscriminate and unregulated promotion or publication of
business closure or going out of business sales will have a
detrimental and adverse impact on the public health, safety and
welfare.
(3) Certain businesses have commenced operations only to engage in
a protracted period of business closure or going out of business
sales activities as a discount marketing technique.
(4) Establishing a waiting period for a going out of business
permit will help alleviate the inappropriate business closure or
going out of business sales marketing techniques and will protect
the public health, safety and welfare of the City, by preventing
the abusive and detrimental effects of business closure or going
out of business sales marketing techniques.
SECTION 3 . PUBLICATION. The City Clerk is hereby ordered and
directed to certify to the passage of this ordinance and to cause
the same or a summary thereof or a display advertisement duly
prepared according to law, to be published in accordance with the
law.
