HomeMy WebLinkAbout1394 - ORDINANCES - 9/4/1991 ORDINANCE NO. 1394 AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA, AMENDING SECTION 2.06.010 (a) OF THE PALM SPRINGS MUNICIPAL CODE, RELATING TO APPOINTMENTS, TERMS AND VACANCIES ON BOARDS AND COMMISSIONS. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA DOES ORDAIN, as follows: SECTION 1. Section 2.06.010 (a) of the Palm Springs Municipal Code is hereby amended to read as follows: "2.06.010 General rules regarding appointments, terms, vacancies. (a Unless otherwise provided by law, or by ordinance adopted after the effective date hereof, all members of boards and commissions of the city shall be appointed for four-year terms commencing on July 1 of the year of appointment; provided, that interim vacancies shall be filled by appointment for the unexpired term of the member replaced. Except in cases where the mayor or city council are not the appointing authority, no person shall be appointed to or serve substantially more than one full term upon any board or commission, and shall then become ineligible for appointment to any board or commission for a period of one year from the expiration of his or her service upon any board or commission; provided that any person appointed to an interim vacancy of twelve 12 months or less, shall be eligible for appointment to a full term upon the same board or commission to which the interim appointment was made. After the expiration of one year during which the person has not served upon any board or commission, that person, if otherwise qualified, shall again become eligible for appointment to any board or commission, including without limitation, the board or commission upon which he or she formerly served. Any member may be removed from office at any time, with or without cause, by a majority vote of the city council , except in cases where the mayor or city council are not the appointing authority, in which cases such regular appointing authority may exercise this power of removal . If a member absents himself without advance permission of the board or commission or of his appointing authority, from three consecutive regular meetings or from twenty-five percent of the duly scheduled meetings of the board or commission within any fiscal year, the chair of the board or commission shall file a certification with the city clerk that such absences have occurred, and his or her office shall thereupon automatically become vacant and shall be filled as any other vacancy. SECTION 2. EFFECTIVE DATE. This ordinance shall be in full force and effect thirty (30) days after passage. SECTION 3. PUBLICATION. The City Clerk is hereby ordered and directed to certify to the passage of this Ordinance, and to cause the same, or a summary thereof, or a display advertisement, duly prepared according to law, to be published in accordance` with law.
