AN ORDINANCE OF THE CITY OF PALM SPRINGS,
CALIFORNIA, AMENDING THE ZONING ORDINANCE
IN REGARD TO THE PUBLIC ARTS FEE AND REAL
ESTATE SIGNS.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DOES ORDAIN AS
FOLLOWS:
SECTION 1. Section 9311..00 of the Zoning Ordinance is amended to read as
follows:
"All development projects (new construction and remodels), except:
single-family residences, private educational institutions which provide
(Typographi- general education equivalent to the public school system (kindergarten through
cal error - high school or any part thereof) , anjipermits. This fee shall be used to
insert as `' providerpublic ar£; or'oher a1 Ei�nate public amenities, on the project site
shown at at the discretion of the City Council or its authorized designee."

this pager, SECTION 2. Section 9320.07 of the Zoning Ordinance is amended to read as

1. Sale, Lease or Exchange Signs not Including Single Family

subject to the following provisions:
a. The size of the sign shall not exceed six (6) square feet
for properties up to one (1) acre in size, or twelve (12)
square feet for properties in excess of one acres No sign
shall be longer than four (4) feet in any direction.
b. The sign shall be single-faced and the co'Vors including
logos shall be ivory and brown. Posts shall be brown, black
or ivory in color.
C. The distance from the ground to the bottom edge of the sign
shall not exceed four (4) feet and the sign face shall be
parallel with the street.
d. The information displayed on the sign shall include the
following:
1. That the property is for sale, lease, or exchange by
the owner or his/her agent;
2. The owner's or broker's name; and
3. The owner's or broker's address or telephone number.
e. Multi-Tenanted Buildings. In addition to the signage

Exchange sign shall be permitted for each space or unit in a
multi-tenanted building subject to the following provisions:
1. Such sign shall be placed in the windows of the space
or if there is no window, adjacent to the door. The
sign shall not exceed two (2) square feet.
2. The information displayed on the sign shall include
the following:
a. That the property is for sale, lease, or
exchange by the owner or his/her agent;
, - affordable housing developments receiving city, state, or Federal assistance shall
be subject to payment of a public arts fee equivalent to one percent (1%) of the
total construction valuation of the project payable at the time of V A

b. The owner's or broker's name; and
C. The owner's or broker's address or telephone
number.
3. The colors, including logos, shall be ivory and brown.
Posts shall be brown, black or ivory in color.
4. Such signs shall not be visible from the public right-
of-way unless located at least fifty (50) feet from
such right-of-way.
2. Sale, Lease or Exchange Signs for Single Family Property. During

exchange, one (1) sign so indicating may be located on the
property by the owner or his/her authorized agent, subject to the
following provisions:
a. The size of the sign shall not exceed two (2) square feet.
b. The sign, including logos, shall be single faced and shall
be ivory and brown. Posts shall be brown, black or ivory in
color.
C. The bottom edge of the installed sign shall not be more than
three (3) feet from the ground, and the sign face shall be
parallel with the street.
d. The information displayed on the sign shall include the

1. That the property is for sale, lease, or exchange by

2. The owner's or broker's name; and
3. The owner's or broker's address or telephone number.
e. One (1) small added sign, commonly reFerred to as a "rider`

(i ) A metal box not to exceed 270 cu. in. or 9x12x2k
inches in size, and ivory or brown in color, may
be attached to the "main" sign or its post. The
top of the box may contain the agent's name
and/or telephone number and the face of the box
may contain only the word "brochure" printed in
letters no larger than Vi inches in height, and
brown or ivory in color.
3. Open House Signs. In addition to the above real estate
a e xc ange signs in items I and 2, one (1.) "Open House" sign
may be permitted only during the time an owner or owner's agent is
on the premises, subject to the following provisions:

a. Such signs shall be permitted only during the hours from
8:00 a.m. until sunset.
b. The size of the sign shall not exceed) two (2) square feet.
C. The sign may be double-faced and the colors shall be ivory
and brown. Posts shall be brown, black or ivory in color.
d. The bottoms edge of the installed sign shall not be more
three (3) feet from the ground.
e. The sign shall be located on the property being offered for
sale only.
4. Vacant Lots and Land Not Including Single-Family Property. During
e perio -of-time win rea y is o ei_e or sa e, lease or
exchange, one (1) sign so indicating may be located on the
property by the owner or his authorized agent, subject to the
following provisions:
a. The size of the sign shall be governed by the size of the
property as follows:
(1) For lot sizes less than forty thousand (40,000) square
feet, the size of the sign shall not exceed six (6)
square feet.
(2) For lot sizes forty thousand (40,000) square feet or
greater, the size of the sign shall not exceed twelve
(12) square feet.
b. 'The information displayed on the sign shall include the
following:
(1) That the property is for sale, lease, or exchange by
the ov;iner or his/her agent;
(2) The owner's or broker's name; and
(3) The owner's or broker's address or telephone number.
C. The colors including logos shall be ivory and brown. Posts
shall be brovin, black or ivory in color.
5. Land Subdivision Signs
In-lieu of, but not in addition to any other sale, lease, or
exchange sign permitted under this Ordinance, signs advertising
land subdivisions shall be permitted upon recordation of the final
subdivision map subject to the following provisions:
as One (1) double-faced sign as follows:
(1) The size of the sign shall not exceed twenty (20)
square feet per side, and the sign may be
perpendicular to the street; or
b, Two (2) single--faced signs as follows:
(1) The size of each sign shall not exceed twenty (20)
square feet and the signs shall be parallel to the
street.
(2) Such signs shall be a minimum of two hundred (200)
feet apart.
(3) Placement of such signs shall be approved by the
Director of Community Development.
C. Such signs shall not be illuminated. 1103

d. Such signs shall be removed at the end of one (1) year from
date of erection, or when ninety (90) percent of the subdi-
vision is sold, whichever occurs first.
6. The design and placement of temporary real estate open house
directional signs are subject to the following provisions: (Ord.

1. Such signs must be related to a single-family or
individual condominium dwelling unit which is offered
for resale purpose only. (Ord. 1333, 06/07/89)
2. The information displayed on the sign shall include
the words "Open House" together with a directional
arrow, and may include the following:
a. That the property is for sale, lease, or
exchange by the owner or his/her agent;
b. The owner's or broker's name; and
C. The owner's or broker's address or telephone
number.
3. Such sign shall be ground-mounted and the bottom edge
of installed signs shall not be more three (3) feet

4. Such signs shall not be placed in the public right-of-
way or on any public property, and shall only be
placed on private property with the consent of the
property owner. (Ord, 1333, 06/07/89)
6. Such signs shall only be in place during daylight
hours. (Ord. 1333, 06/07/89)
6. Mo flags, banners, streamers, pennants or other
adornment shall be permitted in association with the
placement of such sign. (Ord. 1333, 06/07/89)
7. The size of such signs shall not exceed two (2) square
feet. (Ord. 1333, 06/07/89)
8. Such signs may be double-faced and the colors shall be
ivory and brown. Posts shall be brown, black or ivory

9. Two such signs shall be allowed for each unit offered
for resale. (Ord. 1333, 06/07/89)
10. Only one such sign shall be installed at any one
location. (Ord. 1333, 06/07/89)
11. A City permit is required for each sign and such
permit shall be affixed to the sign in such a way as
to be visible from the street.
SECTION 3. EFFECTIVE DATE. This Ordinance shall be in full force and effect
thirty (30) days after passage.
SECTION 4. RETROACTIVE. Section 1 of this Ordinance shall retroactively
apply to all building permits issued since January 6, 1988.

SECTION 5. PUBLICATION. The City Clerk is hereby ordered and directed to
certify to the passage of this Ordinance, and to cause the same or a summary
thereof or a display advertisement, duly prepared according to law, to be pub-
lished in accordance with law.
