AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM
SPRINGS, CALIFORNIA, ADDING SECTION 3.24.036 TO THE
PALM PALM SPRINGS MUNICIPAL CODE IMPOSING AN ADDITIONAL
ONE PERCENT (1%) TRANSIENT OCCUPANCY TAX, AND AMENDING
CERTAIN OTHER SECTIONS OF CHAPTER 3.24 OF THE MUNICIPAL
CODE.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DOES HEREBY
ORDAIN AS FOLLOWS:
SECTION 1 . Section 3.24.036 is hereby added to the Palm Springs
Municipal Code to read as follows:
3.24.036 Additional tax imposed - use of proceeds. In
addition to the tax imposed by Section 3.24.030 and Section
3.24.035, for the privilege of occupancy in any hotel on
or after August 1 , 1991 , each transient is subject to and
shall pay an additional tax in the amount of one percent
of the rent charged by the operator. The additional tax
imposed by this section shall be administered and collected
in the same manner, and is subject to all of the same
definitions, exemptions, rules and regulations as the tax
imposed by Section 3.24.030, except that the tax imposed
by this section shall be paid into the general fund of
the city to be used for the usual and current expenses
of the city, and the provisions of Section 3.24.310 shall
not apply to the tax imposed by this section.
SECTION 2. Line 5 of Subsection (8) of Section 3.24.020, which states
"period of thirty consecutive calendar days or less, counting
" is deleted and replaced with the following: "period
of twenty-eight consecutive calendar days or less, counting
" Except for this revision, Section 3.24.020(8) shall
remain in force as currently written.
SECTION 3. Subsection (b) of Section 3.24.060 is deleted in its entirety
and replaced with the following:
"(b) At the time of making an application for a registration
permit, the applicant shall pay a registration fee of
twenty-five dollars for each permit issued."
SECTION 4. The first sentence of Section 3.24.100 is deleted in its
entirety and replaced with the following:
"Any operator who fails to remit any tax to the city or
any amount of tax required to be collected and remitted
to the city, including amounts based on determination made
by the tax administrator under Section 3.24.120, within
the time required, shall pay a penalty of the greater of
fifty dollars or ten percent of the tax or amount of the
tax in addition to the tax or amount of taxes, plus interest
at the rate of one percent per month, or fraction thereof,
from the date on which the tax or the amount of tax required
to be collected becomes delinquent until the date of
remittance or payment. "
The second sentence of Section 3.24.100 shall remain in
force as currently written. /

SECTION 5. Effective Date_. This ordinance, being an ordinance relating
to taxes for the usual and current expenses of the city,
shall take effect immediately upon its passage, pursuant
to Government Code Section 36937 (d).
SECTION 6. Severability. In the event any section, subsection,
sentence, clause, phrase, or portion of this Ordinance
is for any reason held invalid or unconstitutional by any
court of competent; jurisdiction, such portion shall be
deemed as a separate, distinct, and independent provision,
and such holding shall not affect the validity of the
remaining portions of 'this Ordinance.
SECTION 7. Publication. The city clerk is hereby ordered and directed
to certify to the passage of this ordinance, and to cause
the same or a summary thereof or a display advertisement,
duly prepared according to law, to be published in accordance
with law.
